Proposal:
Deed of Variation to the Section 106 legal agreement attached to planning permission ref. 69827/APP/2021/1565, dated 18/11/2022 (Erection of a ground, mezzanine and 12 upper floors plus roof top plant and basement apart-hotel (Use Class C1) building to provide guest rooms and associated ancillary facilities, and associated landscaping/public realm works). It is proposed to secure: 1) That planning permission ref. 69827/APP/2015/4719, dated 13/09/2016, (Original Planning Permission) will not implemented and that no further work will be carried out under this permission; 2) That planning permission ref. 69827/APP/2021/1565, dated 18/11/2022, (Second Planning Permission) will be implemented; 3) That Community Infrastructure Levy (CIL) Liability for the Second Planning Permission will be paid to the Council in full and that the Council will not pursue for any monetary obligations, CIL or discharge of Conditions in respect of the Original Planning Permission.
