ⓘ Why are there more HMO applications than before?
HMO Planning Requirements Before December 2025
Before the new rules took effect, Hillingdon operated under a "two-tier" system based on the size and location of the property. Large HMOs—defined as properties housing seven or more unrelated people—were classified as sui generis and have always required a formal planning application across the entire borough.
However, small HMOs (housing between three and six people) were generally considered "permitted development". This meant owners could convert a family home into a small HMO without any planning permission, provided the property was not located in a restricted area.
Specifically, planning applications for small HMOs were only mandatory if the property was located within the former Brunel or Uxbridge South wards. In those two wards, an Article 4 Direction was already in place to protect the character of neighborhoods surrounding the university. In all other parts of the borough, these conversions could proceed without council oversight.
HMO Planning Requirements After December 2025
As of December 11, 2025, the council implemented a borough-wide immediate Article 4 Direction. This removed permitted development rights for small HMOs in all 21 wards of Hillingdon, eliminating the distinction between "hotspot" wards and the rest of the borough.
Now, every new HMO conversion, whether for three people or ten, requires a full planning application before the change of use can legally occur. This gives the council the power to assess every proposal against local policies regarding parking, waste storage, and the impact on residential amenity.
Why Planning Applications Have Increased
There are significantly more planning applications for HMOs today than a year ago because the council effectively closed the legal route that previously allowed small HMOs to be created without oversight. The increase is driven by three main factors:
Mandatory Compliance: New conversions in the 19 wards that previously allowed permitted development must now submit formal applications.
Regularisation: Landlords with existing small HMOs are now filing for Certificates of Lawful Use to officially document that their properties were established before the new restrictions began.
Increased Enforcement: The council now requires investigation into all HMO complaints to verify their planning status, as many small HMOs no longer have automatic rights to operate without permission.
