The scheme will be delivered by Uxbridge College assisted by a partner. A specialist security training provider will be appointed with referrals via Job Centre Plus (JCP). The details are outlined in this report. Putting our Residents First The report supports the Council objectives of strong financial management. Financial Cost This report seeks to allocate £53,800 from four identified S106 contributions held by the Council to finance the scheme outlined in this report. Reasons for recommendation Following a Cabinet decision in March 2009, the allocation of Section 106 (S106) and Section 278 (S278) funds is required to be formally approved by the Leader of the Council and the Cabinet Member on a case -by-case basis. This report requests the approval for the S106 funds held at the case reference detailed in this report to be committed as outlined in this report. Alternative options considered / risk management The Cabinet Members may agree to fund the scheme and / or suggest alternative projects to which funds could be allocated within the terms of the relevant legal agreements. If the S106 funds are not allocated to an appropriate scheme, the unspent funds may need to be refunded. Policy Overview Committee comments None at this stage. SUPPORTING INFORMATION 1. Planning obligations, or S106 agreements, are an established mechanism for mitigating planning effects arising from development proposals. The agreements are usually negotiated within the context of planning applications, between Local Planning Authorities and persons with an interest in the piece of land (owners, leaseholders or developers). They are intended to make development acceptable, which would otherwise be unacceptable in planning terms. 2. Any S106 monies generated f rom planning agreements must be spent on their intended purpose and the associated development contribute to the sustainability of the area by addressing the impacts of the development proposals. As a result, expenditure of S106 funds must relate to a specific development and must be in accordance with the corresponding legal agreement. If a contribution is not used for the intended purpose or not spent within the period allocated in the S106 agreement, the monies may need to be returned. 3. In July 2008, the Council adopted a Supplementary Planning Document for Planning Obligations which outlined the Council's approach, policies and procedures in respect of planning obligations. This document has been replaced by the Updated Planning Obligati ons SPD (adopted July 2014) which reflects the introduction of Hillingdon's Community Infrastructure Levy (CIL). The original SDP is, however, still relevant for contributions negotiated before the introduction of CIL on 1 August 2014 and provides stakehol ders with a fair, transparent and predictable basis for the implementation of S106 agreements. Details of the financial planning obligations held by the Council and the progress being made in their allocation and implementation are reported to Cabinet on a quarterly basis through the 'Planning Obligations Cabinet Member Report – 16 April 2021 Page 3 Part I - Public Financial Monitoring Report.' The purpose of this report is to further assist in providing a transparent approach to the allocation of S106 funds. Planning Background – S106 developer obligations taken towards hospitality training. 4. The contributions outlined in Appendix 1 were taken in relation to planning applications which were expected to generate significant employment opportunities in the hospitality industry. Planning permission was therefore approved subject to the developer p roviding a financial contribution to be used by the Council to help Borough residents acquire specific skills to enable them to access jobs in the sector. The level of contribution was calculated in proportion to the size and type of the development and in accordance with the Council’s Supplementary Planning Document on Planning Obligations 2008 (updated July 2014). Proposed allocation 5. Officers are requesting that the financial contributions held at PPR137/409C, PPR124/398A, PPR142/419C and PPR149/433A (totalling £53,800) be allocated towards the provision of a venue door security and compliance staff training and employment scheme as proposed by Uxbridge College (HCUC) and outlined in paragraphs 6-14 below. Proposed scheme – Venue door security and compliance training employment scheme to be delivered by Uxbridge College (HCUC) Evidence of need 6. The Covid pandemic has affected many aspects of the hospitality industry and how it is required to operate. After the original lockdown restrictions were lifted in the summer of 2020, there was a requirement within the hospitality and leisure sectors to ensure that premises complied with the relevant level of Covid compliance associated with the tier applied to Hillingdon. Much of the responsibility for ensur ing compliance fell to untrained staff within the hospitality sector who became de facto security and ‘gatekeepers’ in terms of ensuring residents seeking to gain entry to premises were compliant with the ever-changing Covid requirements. During this period, it became increasing ly clear that there was a need for accredited security training for entrance staff. 7. It is equally clear that as we come out of the current lockdown there will be a continued need for door security and compliance staff to be provided at hospitality venues. 8. There are no Government funding streams available for the accredited Level 2 Award in Door Supervision qualification or the cost of the licence. The local JCP has a significant number of unemployed residents who are interested in gaining this qualification to enabl e them to seek employment in the hotel, hospitality and leisure sectors. The proposal and targets 9. Uxbridge College has submitted a proposal to deliver this venue security and employment initiative in partnership with Airconsulteam, which has successfully assisted in delivering previous Cabinet Member Report – 16 April 2021 Page 4 Part I - Public employment projects. Once funding has been confirmed, a Security In dustry Authority (SIA) accredited training provider will be appointed to deliver Level 2 Award in Door Supervision qualification: either at the college or at another local venue within easy reach for out -of-work Hillingdon residents. 10. The local Job Centres and community partners will refer unemployed residents to the scheme and participants will be offered two pathways. Full offer: Level 1 Certificate in Personal Development for Employability training course leading onto a 5-day accredited Level 2 Award in Door Supervision in the Private Industry Security course. Express offer : participants who have previously completed the Level 1 Employability course, or can evidence they do not require it, can go straight onto the Level 2 Door Supervision course. 11. Proposed targets include: • 40 out-of-work Hillingdon residents recruited and trained • 30 job starts 12. Referrals will be assesse d to ensure they meet SIA’s 5-year checkable history requirement, and the scheme will assist participants who pass the qualification to apply for and fund their SIA Licences at a cost of £220 each. 13. The college and its partner will engage with a number of hospitality, hotel and leisure sector employers who have security job vacancies. Each successful participant will be assisted to apply for these vacancies and receive in-work support for 3 months. 14. The initiative will serve to provide training for residents which will lead to immediate employment for residents and at the same time provide the Borough with a fully trained resource for the future. In addition to providing employment opportunities for r esidents, the initiative will serve to make Hillingdon’s hospitality more secure and safe to use by the wider Hillingdon community. Allocating the above S106 contributions meets the conditions stipulated in the S106 agreements. The scheme will be accounted for under S106 funded revenue projects. The S106 contributions held at PPR/124/398A, PPR/137/409C and PPR/142/419C are at a high risk of being returned to the developer if not utilised by November 2021, December 2023 and August 2025 respectively. RESIDENT BENEFIT & CONSULTATION The benefit or impact upon residents, service users and communities The recommendations will enable external funds to be spent to maximum effect to provide viable improvements for the benefit of local communities. CORPORATE CONSIDERATIONS Corporate Finance Corporate finance concurs with the financial implications above, noting that the employment training scheme will be funded from developer contributions in accordance with the planning obligation agreements, with no impact on Council resources. Legal Decisions on the release of monies for allocation/capital release are delegated to the Leader jointly with the Cabinet Member. This is contained at Article 7.08 paragraph (e) 11 and 12 of the Cabinet Scheme of Delegations of the Council's Constitution. The recommendations therefore fall within the Leader's and the Cabinet Member ’s individual delegations. Legal Services have considered the content of the Section 106 agreements referred to in this report and concludes that the recommendations presented are consistent with the terms of the respective agreements. Infrastructure / Asset Management There are no Infrastructure/Asset Management implications arising from the recommendations in this report.
