Summary
To inform the Cabinet Member on the results of the statutory
consultation for proposed waiting restrictions in Torcross
Road/Barnstaple Road, Ruislip.

This report supports the Council objective of Our People. The
request can be considered as part of the Council’s annual
programme for on-street parking controls.
Financial Cost The estimated cost associated with the recommendations to this
report is £40 and will be funded from existing revenue budgets
within the Transportation service.

That the Cabinet Member for Public Safety and Transport:
1. Notes the comments received during the statutory consultation for the proposed
introduction of waiting restrictions in Torcross Road/Barnstaple Road, Ruislip.
2. Asks officers to proceed with the introduction of the proposed waiting restrictions in
Torcross Road/Barnstaple Road, Ruislip as shown on the plan attached as Appendix
A of this report.

Reasons for recommendations
To respond to the views submitted by residents from the Council's consult ation on the proposed
installation of waiting restrictions in Torcross Road/Barnstaple Road, Ruislip, which was fully
supported by all three Ward Councillors.
Alternative options considered / risk management
None at this stage.

SUPPORTING INFORMATION
1. Torcross Road and Barnstaple Road are both mainly residential Roads within Cavendish
Ward.
2. The Council received t hree requests from local resident s asking for a short section of
double yellow lines to be installed outside Nos 68 and 68a Torcross Road to improve access
and egress to the road and improve sight lines. As a consequence, a detailed site investigation
was undertaken by Council officers and proposals developed which can be seen in Appendix
A.
3. The proposal was taken through the statutory 21-day consultation process which involved
the placing of advertisements in the local press, the London Gazette and the display of public
notices on site.

During the consultation the Council received an objection to the proposed waiting
restrictions stating their reasons for objecting as:
“Further to the letter we received from the Council today, I would like to reject the proposal for
double yellow lines on the corner of Torcross and Barnstaple Road. This has singled us out
as a resident of Hillingdon; we feel victimised as we are recently new residents to the area.
There are parking issues for numerous residents, from the moment the double yellow lines
were put in over six months ago. on occasions we now have an over 5 minute walk home after
parking our vehicle on adjacent roads. This is an issue as I have had over £1000 pounds on
tools stolen in addition to having a child on the way
Parking is already an issue for numerous residents, especially since the double yellow lines
have come in to play on the ‘green triangle”.
2. In view of the objection received, views were sought from the local Ward Councillors on
the concerns raised and the initial requests from other local residents. Whilst sympathetic
to the objector's dilemma, on balance the Ward Councillors support the introduction of the
proposed double yellow lines to promote road safety.

Financial Implications
The estimated cost to 'make' the Traffic Management Order' for the 'At Any Time' waiting
restrictions on Torcross Road and Barnstaple Road is approximately £40 and will be managed
within existing Transportation revenue budgets.

Statutory consultation was carried out by the insertion of public notices in a local newspaper and
displayed on site.
CORPORATE CONSIDERATIONS
Corporate Finance
Corporate Finance has reviewed the recommendations to this report and concurs with the
financial implications as set out above.
Legal
The decision makers must ensure that there is full consideration of the representations that have
been received in exercising the power not to proceed with the proposal for waiting restrictions on
Torcross Road and Barnstaple Road , Ruislip. The consultation and order making statutory
procedures that should be followed in this case are set out in The Local Authorities’ Traffic Orders
(Procedures) (England and Wales) Regulations 1996 (SI 1996/2489).
If the decision is taken to make the proposed order, Part V of the Road Traffic Regulation Act
1984 and the Traffic Signs Regulations and General Directions 2016 set out the signage
requirements, which must be observed.
In considering consultation responses , section 122 of the Road Traffic Regulations Act 1984
means that the Council must balance the concerns of the objectors with the statutory duty to
secure the expeditious, convenient and safe movement of vehicular and other traffic.
There are a set of well-established common law rules which set out the requirements of a lawful
public consultation which are known as the Gunning principles. They were endorsed by the
Supreme Court in the Moseley case. The principles can be summarised as follows:
• Consultation should occur when proposals are at a formative stage;
• Consultations should give sufficient reasons for any proposal to permit intelligent
consideration;

• Consultations should allow adequate time for consideration and
response; and
• The product of consultation should conscientiously be taken into account by the decision
maker.
There are a very significant number of judicial review cases which involve successful challenges
to the lawfulness of a consultation undertaken by a public authority, so it is im perative that the
Gunning principles are closely followed in this case.
