Notice is hereby given that the following decision(s) have been made today by

Decision Approved
The Leader of the Council, in consultation with the Cabinet
Member for Children, Families & Education:
1) Approved the interim commissioning arrangements
for mediation services with Global Mediation until
31st March 2026 at a value of £162,600
2) Approved the extension of legacy arrangements
with KIDS to conclude all outstanding mediation
services for 2023/24 and 2024/25 of £164,573.
Reason for decision
It is a statutory requirement (set out in the SEND code of
practice 2015) that families have access to a mediation service
if the Council makes a decision not to issue an EHCP after an
assessment.
‘The local authority must also inform the child’s parent or the
young person of their right to appeal that decision and the time
limit for doing so, of the requirement for them to consider
mediation should they wish to appeal, and the availability of
information, advice and support and disagreement resolution
services’.

considered and
rejected
1. Do Nothing
This was not a viable option as a compliant contract
must be in place under Procurement regulations.
2. Not commission a Mediation service
There is a statutory duty on the Council to offer a
mediation service to families where an EHCP request is
declined, or if families would like to dispute an EHCP .
Therefore, this is not a viable option.

the relevant officer(s) and the decision must then be put on hold.
