Putting our Residents First Delivering on the Council Strategy 2022-2026 This report supports our ambition for residents / the Council of: Stay living independently for as long as they are able This report supports our commitments to residents of: Safe and Strong Communities The request can be considered as part of the Council’s annual programme of road safety initiatives. Financial Cost The estimated cost associated with the recommendations to this report is £400 and will be managed within existing revenue budgets for the Transportation Service. Notes the application for a disabled parking bay in Brampton Road, Hillingdon; 2. Considers the objections to the proposed disabled persons’ parking bay on Brampton Road, Hillingdon; and 3. Ap proves the installation of the proposed disabled persons’ parking bay on Brampton Road, Hillingdon, as shown in Appendix B to this report. Cabinet Member Report – 24 November 2025 Page 2 (Part 1 Public) Reasons for recommendation(s) The formal disabled parking bay is intended to benefit disabled people by designating a parking space for the use of Blue Badge holders. Alternative options considered / risk management The Council could decide not to proceed with the installation of the proposed disabled persons’ parking day on Brampton Road, Hillingdon. Select Committee comments None at this stage. SUPPORTING INFORMATION 1. Brampton Road is a residential road within Hillingdon East Ward. Approximately half of properties have access to off -street parking. The other half are not able to have off -street parking due to the layout of the road. The road links Clifton Gardens with The Larches. A plan of the area is shown on Appendix A to this report. 2. The Council received an application for a disabled parking bay from a resident of Brampton Road. The applicant fully meets the Council's assessment criteria for the provision of an on- street disabled parking bay. A proposal was developed for an on-street disabled parking bay on Brampton Road, the closest location to the resident’s property whilst maintaining as much parking for other residents. 3. Approval was subsequently granted by Delegated Officer’s Action to progress this proposal to the statutory consultation stage. Formal notice was given of the Council’s intentions for statutory consultation on the proposal shown in Appendix B to this report, and a 21- day notice of intent was duly published. During this period, the Council received two objections to this proposed disabled parking bay. 4. The first objector stated “ I am writing about the proposed disabled parking bay and where it’s been allocated, I would suggest the disabled bay be moved to the side of the road and not where it’s currently being allocated ( I will attach photos) there is limited parking for the amount of residents and putting a disabled bay in the semi -circle will end up taking up 2 parking spaces and not just 1 reducing the amount of parking for the other residents. As the road is becoming increasingly busy, could more parking be available for the residents? I would be happy to pay for a dropped kerb so I could have a drive but this has been rejected in the past. Any help with the parking situation would be greatly appreciated.” 5. The second objector stated ”I do not think a disabled bay will be any good where it has been decided to be put as parking is bad enough around here already. I did not realise there was anyone that lives along this bit that would require a disabled bay anyway. Would be better to allow some sort of dropped kerb so everyone can have driveways. Too many cars around here that are not the residents and some are the residents but haven't been used for months / years.” Cabinet Member Report – 24 November 2025 Page 3 (Part 1 Public) 6. T he proposed formal disabled parking bay in Brampton Road would be available for any Blue Badge holder to use without time limit. The Council continually reviews the use of on - street disabled parking bays and will consider their removal if they are no longer required due to either a change in circumstances, are reported to be unused, or the resident has moved away. The Council aims to install disabled bays as close to the resident's property as possible. 7. Vehicles are already parking in this semi -circle part of the road. The width of the bay is a standard width and would not take up two parking spaces. Placing the bay on the straight part of the road is further away from the disabled resident’s property and may affect their quality of life. 8. The views of Ward Councillors were sought, and all three have responded supporting the proposed bay. 9. Whilst it is understood that the provision of Blue Badge disabled bays can lead to strong feelings both for and against their introduction, the bay is proposed where residents already park and would not restrict access to any dropped kerb or the free flow of traffic. It is therefore recommended that the Council proceeds with the installation of the disabled parking bay on Brampton Road, as shown in Appendix B to this report. Financial Implications The cost associated with the recommendations to this report is estimated at £4 00 and will be managed within existing revenue budgets for the Transportation Service. RESIDENT BENEFIT & CONSULTATION The benefit or impact upon Hillingdon residents, service users and communities The proposed disabled parking bay is intended to benefit disabled people by designating a parking space for the sole use of Blue Badge holders. Consultation & engagement carried out (or required) Consultation has been carried out on this proposal through a notice on site and in the local press. Local Ward Councillors have also been consulted. CORPORATE CONSIDERATIONS Corporate Finance Corporate Finance has reviewed the recommendations to this report and concurs with the financial implications as set out above. Cabinet Member Report – 24 November 2025 Page 4 (Part 1 Public) Legal The Council’s power to designate the proposed disabled parking bay on Brampton Road, Hillingdon is set out in section 45 of the Road Traffic Regulation Act 1984. The consultation and order-making statutory procedures to be followed are set out in Schedule 9 of the Road Traffic Regulation Act 1984 and the Local Authorities’ Traffic Orders (Procedures) (England and Wales) Regulations 1996. Consultation must also meet the standard set by established common law principles in public law, namely fairness and adequacy. If the decision is taken to make the proposed order for the disabled parking bay on Brampton Road, Hillingdon, Part 5 of the Road Traffic Regulation Act 1984 and the Traffic Signs Regulations and General Directions 2016 set out the signage and marking requirements, which must be observed. In exercising any of the powers under the Road Traffic Regulation Act 1984, section 122 of the 1984 Act requires the Council to consider its statutory duty to secure the expeditious, convenient and safe movement of vehicular and other traffic ( including pedestrians), and the provision of suitable and adequate parking facilities on and off the highway. These powers must be exercised so far as practicable having regard to the following matters: (a) the desirability of securing and maintaining reasonable access to premises; (b) the effect on the amenities of any locality affected and the importance of regulating and restricting the use of roads by heavy commercial vehicles, so as to preserve or improve amenities of the areas through which the roads run; (c) the national air quality strategy; (d) the importance of facilitating the passage of public service vehicles and of securing the safety and convenience of persons using or desiring to use such vehicles; and (e) any other matters appearing to the Council to be relevant. Availability for any Blue Badge holder to use the disabled parking bay o n Brampton Road, Hillingdon is a relevant consideration in deciding whether to make th e recommended order. Moreover, the Council has various statutory duties in relation to road safety, such as under section 39 of the Road Traffic Act 1988 and section 16 of the Traffic Management Act 2004, which are relevant when deciding on road traffic measures. Pursuant to established public law principles on consultation, the decision maker, when deciding whether to approve the recommendation to introduce the proposed disabled parking bay on Brampton Road, Hillingdon must be satisfied that all consultation responses (all of which are pasted within this report) , including those that do not accord with the officer's recommendation, were conscientiously taken into account. Regulation 13 of the Local Authorities’ Traffic Orders (Procedures) (England and Wales) Regulations 1996 also requires the Council to consider all objections made. The Council must also be mindful of its public sector equality duty under section 149 of the Equality Act 2010. Property There are no property implications resulting from the recommendations set out in this report.
