Putting our Residents First This report supports the Council objective of Our People. The objection to the consultation will be considered in relation to the Council’s strategy for road safety. Financial Cost The cost associated with the recommendations to this report is estimated at £420 and will be met from within existing revenue budgets for the Transportation Service. Relevant Policy Overview Committee Residents, Education and Environmental Services Relevant Ward(s) Yeading RECOMMENDATIONS That the Cabinet Member for Public Safety and Transport: 1) notes the objections received during the statutory consultation for the proposed ‘At Any Time’ waiting restrictions on Glencoe Road and Airdrie Close, Hayes; and 2) approves the introduction of ‘At Any Time’ waiting restrictions on Glencoe Road but defers the implementation of restrictions on Airdrie Close at the present time and to keep the situation under review. Cabinet Member Report – 2 February 2021 Page 2 Part 1 - Public Reasons for recommendations To improve forward visibility when exiting Airdrie Close onto Glencoe Roa d yet still maintain parking for residents where possible. Alternative options considered / risk management None at this stage. Policy Overview Committee comments None at this stage. SUPPORTING INFORMATION 1. Glencoe Road and Airdrie Close are residential roads within Yeading ward. Both roads are no through roads with Glencoe Road the main route out of the estate. Vehicles park on both sides of the road in a chicane format. There are existing double yellow lines on the junction of Glencoe Road and Airdrie Close and they extend down Airdire Close on one side. A plan of the area is shown on Appendix A to this report. 2. The Council received a request from a local resident concerned with obstructive parking on both Glencoe Road and on Airdrie Close from the end of the existing restrictions. On Airdire Close the concern was damage to the footway caused by goods vehicles having to mount t he footway due to parked vehicles opposite the existing restrictions. Several photos were provided by the resident showing a damaged footway and a skip lorry having difficulties accessing the road. 3. As a result of the concerns raised, Council officers undertook a detailed site investigation and it was observed that vehicles were parked in such a way as to possibly restrict access for larger vehicles such as refuse and emergency vehicles. 4. Following the above, statutory consultation was carried out on possible ‘ At Any Time’ waiting restrictions on part of Glencoe Road and Airdrie Close as shown on the plan attached as Appendix B. 5. During the consultation period the Council received three objections from local residents. In all instances, it would appear that t he main concern expressed by residents is over the loss of on- street parking provision. 6. The first objection was submitted through the local member of parliament and outlines their concerns as: “I am looking for you to support us as a group of residents that are objecting to double yellow lines being placed on Glencoe Road, Yeading the referenc e for this is 3N/ 04/CH/16/09/20 we have already had one lot of double yellow lines put in and they now have decided that they are extending this, it is all very well the council doing this but where on earth are we supposed to park this is totally ridiculous we are struggling to park on an evening as it is without removing at least Cabinet Member Report – 2 February 2021 Page 3 Part 1 - Public another 6-7 parking spaces, there is enough going on at the moment I don’t have the time or energy to keep fight the council on these matter I am sick and tired of it. The closing date for us to respond is the 7 October so we do not have much time but I have only just seen the notice that they stuck to one of our lamp posts.” 7. The second resident stated the following concerns to the proposals: “I would like to lodge an appeal against the planning to extend yellow lines on Glencoe Road and down Airdrie Close in Yeading. “I live in Glencoe Road (opposite Airdrie Close) and the parking on our road can be a nightmare as it is, so to lose potentially another 4-5 spaces is madness. We have limited parking for residents as it is for the following reasons: i) Out local park at the end of the road always has at least 12 boats permanently moored up (they get around this by constantly saying they are working on their boats!). They often park their vans and vehicles on our surrounding roads. ii) We also have football players at weekends parking on our roads as the car park at the community centre at Ditchfield Road has been closed. iii) We have dog walkers and visitors to the park, parking on our road. iv) We have fisherman for the canal parking on our road. “Most household now have more than one car and often are unbale to park near their own home as it is. We have had to park down Airdrie Close before now as it has been impossible to park on Glencoe Road. It is all very well taking a look at the road on a weekday when most people are at work but take a look on a Saturday or a Sunday or later in the evening. “If the yellow lines go down and parking is further reduced for residents then we will find ourselves coming home to the boat people and other people parking outside our houses and then where do we go. “I strongly ask that the Council consider the implications of introducing more yellow lines and causing further issues for the residents paying Council Tax.” 8. The third objector makes the following points: “I reply to your letter date d 11 th September 2020 in regards to extending existing double yellow line. “I would like to disagree with your proposal, as I believe it will not make much difference. “I have discussing about it with my neighbours and they all agree with me. “The reason being is that a lot of people park their cars on this corner, making it a dangerous spot when driving and can cause accidents. Also, bin collection vehicles constantly having problems collecting rubbish because of the cars being parked on that particular corner. Cabinet Member Report – 2 February 2021 Page 4 Part 1 - Public “It is sensible to me that the double yellow lines should be mainly on the corners and/or junctions. I don’t think it would make much differen ce by what you have proposing, hence I would like to disagree with it. “There are a couple of neighbours without driveways or possess more than one car, hence they need to park somewhere, and this would provide them additional 2 parking spaces and avoid any major disruption.” 9. To summarise, the concerns over the loss of parking is not ed. H owever, after careful consideration of the objections raised, Council officers’ site observations and the views of Ward Councillors, it is recommended to proceed with the double yellow lines on Glencoe Road and to keep the proposals for Airdrie Close under review. Financial Implications The estimated cost to implement the proposed changes is approximately £420, which will be managed within existing revenue transportation budgets. RESIDENT BENEFIT & CONSULTATION The benefit or impact upon Hillingdon residents, service users and communities The effect of introducing the proposed waiting restrictions on Glencoe Road will be that safety is maintained at all times whilst maintaining parking for residents in Airdire Close. Consultation carried out or required Consultation has been carried out on this proposal through a notice on site and in the local press. Local Ward Councillors have also been consulted. CORPORATE CONSIDERATIONS Corporate Finance Corporate Finance has reviewed the recommendations to this report and concurs with the financial implications as set out above. Legal The decision makers must ensure that there is full consideration of the representations that have been received. In exercising the power to approve the proposal for 'At Any Time' waiting restrictions such as that set out in the report, the Council have to consider their power to make an order creating a waiting restriction as set out in Part I of the Road Traffic Regulation Act 1984. The consultation and order making statutory procedures that should be followed in this case are set out in The Local Authori ties’ Traffic Orders (Procedures) (England and Wales) Regulations 1996 (SI 1996/2489). Cabinet Member Report – 2 February 2021 Page 5 Part 1 - Public If the decision is taken to make the proposed order, Part V of the Road Traffic Regulation Act 1984 and the Traffic Signs Regulations and General Directions 2016 set out the signage requirements which must be observed. In considering consultation responses , Section 122 of the Road Traffic Regulations Act 1984 means that the Council must balance the concerns of the objectors with the statutory duty to secure the expeditious, convenient and safe movement of vehicular and other traffic. There are a set of well-established common law rules which set out the requirements of a lawful public consultation which are known as the Gunning principles. They were endorsed by the Supreme Court in the Moseley case. The principles can be summarised as follows: • Consultation should occur when proposals are at a formative stage; • Consultations should give sufficient reasons for any proposal to permit intelligent consideration; • Consultations should allow adequate time for consideration and response; The product of consultation should conscientiously be taken into account by the decision maker. There are a very significant number of judicial review cases which involve successful challenges to the lawfulness of a consultation undertaken by a public authority, so it is imperative that the Gunning principles are closely followed in this case. Cabinet Member Decision Notice – 11 February 2021 OFFICIAL DECISION NOTICE PUBLISHED BY DEMOCRATIC SERVICES ON 11 FEBRUARY 2021 The Cabinet Member for Public Safety and Transport has made the following decision today: 1.
