Putting our Residents First The request can be considered as part of the Council’s annual programme of road safety initiatives. Financial Cost There are none associated with the recommendations in this report. Relevant Policy Overview Committee Residents, Education and Environmental Services Relevant Ward(s) Townfield RECOMMENDATIONS That the Cabinet Member for Public Safety and Transport: 1. considers the objection received from the statutory consultation for the proposed ‘At Any Time’ waiting restrictions on Minet Drive, Hayes; and 2. asks officers to defer the proposed ‘At Any Time’ waiting restrictions on Minet Drive, Hayes at the present time. Reasons for recommendation The recommendation s reflect the views expressed by local residents and the local Ward Councillors during the consultation. Alternative options considered / risk management The Council could decide to proceed with the installation of the waiting restrictions as advertised. Cabinet Member Report - 01 February 2021 Page 2 Part I - Public SUPPORTING INFORMATION 1. Minet Drive and Glenister Gardens are mainly residential roads within Townfield Ward . Glenister Gardens is a private development at the easternmost end of Minet Drive and the Council has no plans to adopt the road. A plan of the area is shown on Appendix A to this report. 2. The Council received a request from a local Ward Councillor for measures to remove obstructive parking on the section of Minet Drive opposite Glenister Gardens. As a consequence, a detailed site investigation was undertaken by Council officers. 3. Officers observed that vehicles are currently parking on both sides of Minet Drive. S ome of these vehicles were parked opposite the junction, which restricts access for vehicles exiting Glenister Gardens and through traffic. These parked vehicles could also restrict access for emergency vehicles and refuse lorries. 4. As a result of the sit e observations, proposals were developed to install 'At Any Time' waiting restrictions on Minet Drive opposite Glenister Gardens to help improve road safety and improve access , particularly for the Emergency Services. The proposed restrictions are shown on the plan attached as Appendix B of this report. 5. It was agreed by the Cabinet Member for Planning and Transportation to take the proposal through the statutory 21- day consultation process, which involved the placing of advertisements in the local press and the display of public notices on site. During this period, the Council received one objection to the proposal. 6. The objector stated, "We think this will not resolve the issue fully and might make the situation worse for the residents of Minet Drive... It will push the problem further down the road as due to the shortage of parking in the new houses/flats past Glenister Gardens, the resident will continue to park further down the road at Minet Drive past house No 123, due to the large number of cars and the tight parking spaces and cars parked at both sides of the road, it gets so cramped that sometimes it’s impossible to drive a car to the end of the road. We have made numerous contacts with the Police and the Council as roughly parked cars block the exit. All of the residents don’t feel safe as if we were to need aid from emergency services, the response team vehicles might not be able to get to us or at least will be delayed immensely. Plus the parked cars opposite the dropped kerb makes it difficult to pull bigger cars/vans from the driveway and if we park outside the drive we risk having our vehicles/tools being stolen as two vehicles have already been stolen in the past couple of months. This issue can be resolved if at any time waiting restrictions are applied till the end, on the right side of the road when driving toward the closed end of Minet Drive. Also the space at the end of the road to turn the car around is occupied most of the time by cars, making manoeuvring difficult as there are no restrictions there too. If this issue is resolved the residents of Minet Drive will feel a lot safer. If required the residents will be happy to provide a signed letter that states this is what we want.” 7. The objector is requesting more extensive waiting restrictions than the ones proposed. Whilst the comments are noted, the Council usually would request a clear indication that the majority of loc al residents would support more extensive restrictions than the ones proposed. This can be submitted in the form of a petition, which is extremely helpful in that it shows that concerns are shared by the wider community and not just one or two individuals. The local Ward Councillors have been consulted and one Councillor has expressed concerns and does not support the proposal as more consultation is needed with residents first. 9. After careful consideration of comments received from the statutory consultat ion and the views of the local Ward Councillors , it is recommended that the Cabinet Member agrees to defer the proposal for ‘At Any Time’ waiting restrictions in Minet Drive at the present time. 10. Ward Councillors may wish to consider encouraging residents as a group to consider petitioning the Council if they are able to agree on a suite of measures upon which they can agree. Financial Implications There are none associated with the recommendations in this report. RESIDENT BENEFIT & CONSULTATION The benefit or impact upon Hillingdon residents, service users and communities The effect of introducing the proposed waiting restrictions will be that safety is maintained at all times. Consultation carried out or required Consultation has been carried out on this proposal through a notice on site and in the local press. Local Ward Councillors have also been consulted. CORPORATE CONSIDERATIONS Corporate Finance Corporate Finance has reviewed the recommendations to this report and concurs with the financial implications as set out above. Legal The decision makers must ensure that there is full consideration of the representations that have been received. In exercising the power to approve the proposal for 'At Any Time' waiting restrictions on Minet Drive, the Council have to consider their statutory duty under section 122 of the Road Traffic Regulation Act 1984 to secure the expeditious, convenient and safe movement of vehicular and other traffic. The statutory duty must be balanced with the concerns raised by any objectors. In considering the responses received, the Council must ensure that there is a full consideration of all representations arising incl uding those which do not accord with the o fficer’s recommendation. The Council must be satisfied that the objections from the public have been taken into account. Cabinet Member Report - 01 February 2021 Page 4 Part I - Public The Traffic Signs Regulations and General Directions 2016 govern road traffic signs and road markings. If an Order is made, the Council should ensure that the statutory procedures are followed. The consultation and order making statutory procedures that should be followed in this case are set out in The Local Authorities’ Traffic Orders (Proc edures) (England and Wales) Regulations 1996 (SI 1996/2489).
