Financial Cost The estimated cost associated with the recommendations in this report is £480, to be managed within existing Transportation Service revenue budgets. Considers the objection received from the statutory consultation for the proposed ‘at any time’ waiting restrictions on the junction of Balmoral Drive and Whittington Avenue, Hayes. Approves the introduction of the proposed ‘at any time’ waiting restrictions on the junction of Balmoral Drive and Whittington Avenue, Hayes, as shown at Appendix B to this report. Reasons for recommendation(s) To improve access on the junction of Balmoral Drive and Whittington Avenue yet still maintain parking for residents. Alternative options considered / risk management The Council could decide not to proceed with the installation of the ‘at any time’ waiting restrictions as advertised. Democratic compliance / previous authority None at this stage. Select Committee comments None at this stage. SUPPORTING INFORMATION 1. Balmoral Drive and Whittington Avenue are residential roads within Belmore Ward. Balmoral Drive runs parallel to Uxbridge Road, and it used as a cut through. Whittington Avenue has a footway parking exemption which allow s vehicles to park on the footway. Grange Park Primary School has a pedestrian entrance opposite the junction with school keep clear markings. There are also local shops nearby. A plan of the area is shown on Appendix A to this report. 2. The Council received a request from a resident of Whittington Avenue for waiting restrictions at its junction with Balmoral Drive in order to improve road safety and sightlines, which are reduced due to parked vehicles parking close to the junction. As a consequence, a detailed site investigation was undertaken by Council officers. 3. As the junction is opposite a pedestrian entrance to Grang e Park Primary School , single yellow lines operational Mon - Fri between 8am - 10pm and 2.30pm – 4. 30pm have previously been installed on the junction . Whittington Avenue has a footway parking exemption that starts 15 metres into the road. Officers observed that vehicles were parking on the pavement and on the junction on the existing yellow lines during its operational hours. These vehicles restricted sight lines for vehicles using the junction and pedestrians using the footways especially, which include children walking to school and crossing B almoral Drive close to the junction. 4. The area is part of Parking Enforcement ’s rota outside schools; however, officers in that team advise that they are not able to attend there every day. As a result of the site observations, a proposal was developed to increase the existing single yellow lines to double yellow lines on the junction in order to keep this area clear of parked cars to improve forward visibility and promote road safety. The proposed ‘at any time’ waiting restrictions are shown on the plan attached as Appendix B of this report. 6. The Cabinet Member agreed to take the proposal through the statutory 21-day consultation process, which involved the placing of advertisements in the local press and the display of public notices on site. During this period, the Council received one objection and one letter of support. 7. The objector stated “We are concerned that this proposal will severely limit our parking options, particularly on weekends, where we currently rely on available space for our vehicles. The existing restrictions already impose significant limitations from Monday to Friday, 6 AM to 6 PM. Adding double yellow lines would leave us with no viable alternatives for parking. While we understand the intention to address obstructive parking, we believe that this proposal does not effectively balance the needs of local residents with traf fic management. We kindly urge you to reconsider this decision and explore alternative solutions that accommodate both residents and safety concerns.” 8. The supporter stated “Please go ahead with your plans. I agree no objection from me.” 9. At present, the existing parking restrictions in this area are Mon - Fri between 8am - 10am and 2.30pm - 4.30pm, which allows parking outside these hours. The majority of properties around and on this junction have access to off street parking. 10. The Highways Code 2016, No 243 states “do not stop or park…opposite or within 10 metres (32 feet) of a junction, except in an authorised parking space…”. These proposed restrictions will serve to enhance this existing condition. 11. The local Ward Councillors have been consulted, and one has responded supporting the proposal. 12. After careful consideration of the comments received from the statutory consultation and from the local Ward Councillors, it is recommended that the Cabinet Member agrees to proceed with the proposed ‘at any time’ waiting restrictions in the junction of Balmoral Drive and Whittington Avenue, Hayes shown in Appendix B to this report. Financial Implications The cost associated with the recommendations to this report is estimated at £480 and will be managed within existing revenue budgets for the Transportation Service. Cabinet Member Report – 20 March 2025 Page 4 (Part 1 Public) RESIDENT BENEFIT & CONSULTATION The benefit or impact upon Hillingdon residents, service users and communities The effect of introducing the proposed waiting restrictions on the junction of Balmoral Drive and Whittington Avenue will be that access and safety is maintained whilst maintaining parking for residents. Consultation & engagement carried out (or required) Consultation has been carried out on this proposal through a notice on site and in the local press. Local Ward Councillors have also been consulted. CORPORATE CONSIDERATIONS Corporate Finance Corporate Finance has reviewed the recommendations to this report and concurs with the financial implications as set out above. Legal The Council’s power to implement proposed ‘at any time’ waiting restrictions at the junction of Balmoral Drive and Whittington Avenue, Hayes is set out in section 6 of the Road Traffic Regulation Act 1984. The consultation and order-making statutory procedures to be followed are set out in Schedule 9 of the Road Traffic Regulation Act 1984 and the Local Authorities’ Traffic Orders (Procedures) (England and Wales) Regulations 1996. If the decision is taken to make the proposed order, Part V of the Road Traffic Regulation Act 1984 and the Traffic Signs Regulations and General Directions 2016 set out the signage requirements, which must be observed. In considering consultation responses, section 122 of the Road Traffic Regulation Act 1984 requires the Council to balance the concerns of the objectors with the statutory duty to secure the expeditious, convenient and safe movement of vehicular and other traffic. This statutory duty must be exercised so far as practicable having regard to the following matters: (a) the desirability of securing and maintaining reasonable access to premises; (b) the effect on the amenities of any locality affected and the importance of regulating and restricting the use of roads by heavy commercial vehicles, so as to preserve or improve amenities of the areas through the roads run; (c) the national air quality strategy; (d) the importance of facilitating the passage of public service vehicles and of securing the safety and convenience of persons using or desiring to use such vehicles; and (e) any other matters appearing to the Council to be relevant. Cabinet Member Report – 20 March 2025 Page 5 (Part 1 Public) Pursuant to established public law principles on consultation, namely fairness and adequacy, the decision maker, when deciding whether to approve the recommendation to introduce the proposed waiting restrictions, must be satisfied that all consultation responses, which are set out within this report, were conscientiously taken into account. The Council must also be mindful of its public sector equality duty under section 149 of the Equality Act 2010.
