Does not approve the introduction of the proposed ‘At Any Time’ waiting restrictions on Dawlish Drive, Ruislip, as shown at Appendix B to this report, but to keep the area under review Cabinet Member Report Page 2 (Part 1 Public) Reasons for recommendation(s) These reflect the views of the objectors and local Ward Councillors. Alternative options considered / risk management The Council could decide to proceed with the installation of the ‘at any time’ waiting restrictions as advertised. Select Committee comments None at this stage. SUPPORTING INFORMATION 1. Dawlish Drive is a residential road within Ruislip Manor Ward. Lady Bankes Primary School is located in the road with its only access on Dawlish Drive with school keep clear markings. There are also local shops nearby. A plan of the area is shown on Appendix A to this report. 2. The Council received a request from a resident of Dawlish Drive for waiting restrictions on the bend to improve road safety and sightlines, which are reduced due to v ehicles parking on the bend. As a consequence, a detailed site investigation was undertaken by Council officers. 3. There are single yellow lines and school ‘ keep clear’ markings directly outside the school operational Mon - Fri, 8am - 10pm and 2.30pm – 4.30pm. The rest of the road is available for parking. Officers observed that vehicles were parking on bend. These vehicles restricted sight lines for vehicles. 4. The area is part of Parking Enforcement’s rota outside schools; however, they are not able to be there every day. 5. As a result of the site observations, a proposal was developed to install double yellow lines on the inside of the bend in order to keep this area clear of parked cars to improve forward visibility and promote road safety. The proposed ‘at any time’ waiting restrictions are shown on the plan attached as Appendix B of this report. 6. The Cabinet Member agreed to take the proposal through the statutory 21-day consultation process, which involved the placing of advertisements in the local press and the display of public notices on site. During this period, the Council received one objection and one letter of support. 7. The objector stated “I don't believe there is any inherent safety issue, as there have been no accidents to my knowledge…. Indeed, the restriction on road width and turning circle which parked vehicles produces has the tendency rather to slow vehicles down significantly and probably rather benefits parents and children crossing the road further down to access Lady Bankes School as the speed of the traffic flow is drastically reduced. Vehicles typically park on the area marked during school drop off and pick up times and undoubtedly reduce Cabinet Member Report Page 3 (Part 1 Public) the road width at its 90-degree bend and thus cause inconvenience (as opposed to safety). The advisory lines are ignored. Those most affected are those dropping- off (and thus not residents of the road) and commercial vehicles with greater width/length. I do not personally support the double-yellow proposal, but rather single with time restriction to school hours. My rationale is to preserve the amenity of on- street parking whenever possible to immediate residents e.g. evenings and weekends when they may have visitors and obstruction inconvenience diminishes/evaporates (drop drives limit availability in the street as a whole). This also enables commercial vehicles like school coaches for swimming lessons and food delivery vehicles easier access during school hours.” 8. The supporter stated “We would welcome double yellow lines on the corner as in your diagram. We think it is a great idea as that corner gets very congested (and quite dangerous) at school drop off and pick up time - and can be dangerous at other times too if cars are parked there. It is also extremely hard for coaches and other large vehicles to get around the corner. ………….. I would like to propose double yellow lines are put there too - would that also be an option? That is on the part of the road opposite houses 22, 24, 26. At the moment cars park there all the time, taking no notice of the restrictions (currently single yellow with hours restrictions) and residents can't get out of their driveways. …….Have speed bumps and / or permits also been considered for this road? At school time residents cannot access/leave their driveways because of inconsiderate drivers and zoom down the road, its an accident waiting to happen.” 9. Previous attempts to change the parking arrangements directly outside the school have not been supported by the residents . Therefore, if the residents want other changes to the parking arrangements / permits or ‘ speed humps’, then the best way forward is through a petition to the Council. 10. The local Ward Councillors have been consulted, and both have responded and are minded not to support the proposal at the current time but would be happy for the situation to be kept under review. 11. After careful consideration of the comments received from the statutory consultation and from the local Ward Councillors, it is recommended that the Cabinet Member agrees not to proceed with the proposed ‘at any time’ waiting restrictions o n Dawlish Drive, Ruislip in Appendix B to this report, but keep the area under review. Financial Implications There are no costs associated with the recommendations to this report. RESIDENT BENEFIT & CONSULTATION The benefit or impact upon Hillingdon residents, service users and communities There will be no changes to the parking arrangements on Dawlish Drive. Consultation & Engagement carried out (or required) Cabinet Member Report Page 4 (Part 1 Public) Consultation has been carried out on this proposal through a notice on site and in the local press. Local Ward Councillors have also been consulted. CORPORATE CONSIDERATIONS Corporate Finance Corporate Finance has reviewed the recommendations to this report and concurs with the financial implications as set out above. Legal The Council’s power to implement ‘at any time’ waiting restrictions is set out in section 6 of the Road Traffic Regulation Act 1984. The consultation and order-making statutory procedures to be followed are set out in Schedule 9 of the Road Traffic Regulation Act 1984 and the Local Authorities’ Traffic Orders (Procedures) (England and Wales) Regulations 1996. In exercising any of the powers under the Road Traffic Regulation Act 1984, section 122 of the 1984 Act requires the Council to consider its statutory duty to secure the expeditious, convenient and safe movement of vehicular and other traffic (including pedestrians), and the provision of suitable and adequate parking facilities on and off the highway. These powers must be exercised so far as practicable having regard to the following matters: (a) the desirability of securing and maintaining reasonable access to premises; (b) the effect on the amenities of any locality affected and the importance of regulating and restricting the use of roads by heavy commercial vehicles, so as to preserve or improve amenities of the areas through the roads run; (c) the national air quality strategy; (d) the importance of facilitating the passage of public service vehicles and of securing the safety and convenience of persons using or desiring to use such vehicles; and (e) any other matters appearing to the Council to be relevant. The Council’s statutory duty must be balanced with the concerns raised by any objectors. Moreover, pursuant to established public law principles on consultation, namely fairness and adequacy, the decision maker, when coming to a decision on whether or not the proposal is to be progressed, must be satisfied that all consultation responses, including those that do not accord with the officer's recommendation, were conscientiously taken into account. The Council must also be mindful of its public sector equality duty under section 149 of the Equality Act 2010. In this instance, the consultation responses have informed the recommendation within this report not to implement ‘at any time’ waiting restrictions on Dawlish Drive, Ruislip.
