Democratic Services confirm that this is not a key decision, as such the Local Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2012 notice period does not apply. You should take a decision on or after Thursday 6 May 2021 in order to meet Constitutional requirements about publication of decisions that are to be made. Financial Cost None Relevant Policy Overview Committee Residents, Education and Environmental Services Policy Overview Committee Relevant Ward(s) All RECOMMENDATIONS That the Cabinet Member for Families , Education and Wellbeing approves the amended school term dates for the academic year of 2021/22 due to the additional Bank Holiday provided on Friday 3 rd June 2022, noting that t his has been amended by reducing the number of teaching days from 190 to 189 (plus 5 inset days), totalling to 194 school days. Reasons for recommendation This recommendation is required to comply with Department of Education guidance to ensure that school staff receive the same public bank holiday benefits. SUPPORTING INFORMATION The Department of Education has confirmed through the Local Government Association on 1 April 2021 that all local authorities should make amendments to their 2021/22 school term dates to incorporate the additional Bank Holiday on Friday 3rd June 2022. Cabinet Member Report – 27 April 2021 Part 1 - Public OFFICIAL-SENSITIVE The Spring Bank Holiday in 2022 will be moved to Thursday 2 nd June and an additional Bank Holiday on Friday 3 rd June will see a four -day weekend to celebrate Her Majesty The Queen’s Platinum Jubilee. Schools will already be on their half term break in the week commencing 30th May, but where the additional bank holiday falls in term time, schools and the local authority should observe the Bank Holidays on 2 nd/3rd June and therefore need to prepare and make any amendments to the published term dates for academic Year 2021/22. The Department for Education will review the necessary legislation to make an amendment for the September 2021 version that reduces the number of days that teachers need to be available to work from 190 (+5 inset days) to 189 (+5 ins et days). The total school year for 2021/22 will therefore be 194 days instead of the usual 195 days. RESIDENT BENEFIT & CONSULTATION The benefit or impact upon Hillingdon residents, service users and communities To ensure all residents can participate in this significant national event. CORPORATE CONSIDERATIONS Corporate Finance Corporate Finance has reviewed this report and concurs that there are no direct financial implications associated within the recommendations. Legal Term dates are determined by school employers . The local authority is the employer for community, voluntary -controlled, community special or maintained nursery schools. The Education (School Day and School Year) (England) Regulations 1999 require local authority maintained schools to be open for at least 380 sessions (190 days) during a school year. The Department of Education has confirmed this requirement will be reduced to 189 days to take into account the additional bank holiday in Spring 2022. The proposed amendment to the term dates for the academic year 2021/2022 will therefore meet the relevant legal requirements. There are no other legal issues arising from this report. Cabinet Member Decision Notice – 11 May 2021 OFFICIAL DECISION NOTICE PUBLISHED BY DEMOCRATIC SERVICES ON 11 MAY 2021 The Cabinet Member for Families, Education and Wellbeing has made the following decision today: 1. CABINET MEMBER FOR FAMILIES, EDUCATION AND WELLBEING HILLINGDON SCHOOL TERM DATES AMENDMENT 2021/22 DECISION: That the Cabinet Member for Families, Education and Wellbeing approved the amended school term dates for the academic year of 2021/22 due to the additional Bank Holiday provided on Friday 3rd June 2022, noting that this has been amended by reducing the number of teaching days from 190 to 189 (plus 5 inset days), totalling to 194 school days. REASONS FOR THE DECISION MADE This decision was required to comply with Department of Education’s guidance to ensure that school staff receive the same public bank holiday benefits.
