Notice is hereby given that the following decision(s) have been made today by

Decision Approved
That the Leader of the Council and Cabinet Member for
Health and Social Care approved a direct contract award to
House of Advocacy for the provision of Out of Borough paid
representatives, Best Interest Assessments and Section 12
Doctor Assessments for an eighteen-month period from 1st
October 2023 to 31st March 2025 and at an estimated value
of £119,154.
Reason for decision If a person is losing their capacity and under Deprivation of
Liberty (DoLs), it is mandated that Council’s support people who
are in placements which are out of borough, who do not have
families or friends to support them, or where families require
support. Out of Borough care homes are used where families
want the person to be placed near to them, or where the person
has a network, or as a last resort for the Council finding a
specialist placement. There is a nationwide trend of people being
under DoLs and the Council, therefore, requires more out of
borough paid representatives, as a result of these growing
numbers.
Hillingdon requires a new provider to offer such out of Borough
‘paid representatives’ and provide additional capacity and
resilience on Best Interest Assessments and Section 12 Doctor
Assessments. Providing a ‘Paid Representative’ service is a
requirement to ensure that all Adult Social Care placed residents
living outside of Hillingdon have the statutory support when their

mental capacity is being assessed and they are deprived of their
liberty. If they have no suitable family or friend representative,
the Council must provide this support.
A direct award was deemed most appropriate route to award
because House of Advocacy has the professional network and
capability to carry out the Services to the requirements in line
with statutory obligations.
Alternative options
considered and
rejected
1) To not have this supplier would result in no provision of out of
borough paid representatives and of a delay in the supply of
Best Interest Assessments and some Section 12 doctor
assessments.
2) A decision not to tender was taken because officers have not
found another provider who would be able to carry out this work
for the price and there are limited providers in the market. The
current provider has withdrawn from providing out of borough
paid representatives, as they do not have the out of borough
capacity to provide this service.
