That the Cabinet Member for Financ e and the Cabinet
Member for Residents’ Services:
1. A ccepted the tender and a pproved the award of a
five-year contract (Nov 2023 – Oct 2028) to Ricardo
AEA Ltd for £234,750 to provide an air quality
monitoring service; and
2. Ap proved that a total of £234,750 from the S106 air
quality contributions held by the Council be allocated
towards the provision of the air quality monitoring
service contract for a period of 5 years.
Reason for decision The Council is legally required to manage local air quality. Part
of this legal obligation also requires annual status reports to be
produced based on an effective and comprehensive monitoring
system.
The Council ’s current contract for the provision of air quality
monitoring will terminate in October 2023 and the new contract
should be effective from November 2023 to secure continuity of
the monitoring network and data capture standards. Ricardo has
assisted the Council to continuously monitor ambient air quality,

provide good quality data to all users in full compliance with
current legislation and technical standards.
The service will be fully funded from financial contributions
received from developers for the purpose of discharging S106
air quality obligations and therefore presents no direct cost to
the Council.
Alternative options
considered and
rejected
The Environment Act 1995 introduces the Local Air Quality
Management framework. Under this framework, local
authorities must assess their air quality for the specified
pollutants and submit their Annual Status Reports.
The monitoring and reporting of air quality is a legal requirement
for the Council and therefore it is necessary to ensure that this
workstream continues. The provision of air quality monitoring is
a specialised field. A tender exercise was undertaken to identify
a provider able to meet the Council’s requirements. The Council
does not currently have the in- house expertise to undertake its
own monitoring a nd without the support of a third party would
not be able to meet current statutory requirements.
If the Cabinet members had not agreed to the funding of the
monitoring from S106 , then alternative funding would have
needed to be found and alternative projects identified that
accorded with the relevant legal agreements. If the S106 funds
had not been allocated to an appropriate scheme, the unspent
funds may have needed to be refunded, including any interest
accrued to date.
