Executive Summary This report seeks approval to amend parking arrangements outside No. 19 Kings Road, Uxbridge, to enable the installation of a new vehicle crossover. The proposal is to remove part of the existing Zone U5 permit holder parking bay and replace it with a ‘Monday to Friday, 9am to 5pm’ waiting restriction. The change is required to ensure safe and unobstructed access to a new off-street parking facility at the property, in line with standard Highways practice. Without this amendment, parked vehicles could obstruct the crossover due to overhang beyond marked bays. A formal consultation was undertaken between 20 May and 10 June 2026. One objection was received, citing concerns about the loss of parking and suggesting a reduced restriction. Officers considered this but determined that the proposed spacing is necessary to maintain safe access and consistency with similar crossings in the area. There is no legal basis to refuse the crossover under the Highways Act 1980. The proposed changes comply with the Road Traffic Regulation Act 1984 and relevant consultation requirements. The estimated cost for the notice of making which is combined with other similar amendments across the Borough is £1,000, funded from existing budgets. While there is a minor loss of on- street parking, this is partly offset by new off-street provision. Notes the responses received to the formal consultation for the proposed removal of part of the Zone U5 permit holder parking place outside No. 1 9 Kings Road, Uxbridge to accommodate the installation of a new vehicle crossover; and 2. Following advice from the Council’s Highways Team, approves that the part of the permit holder parking place outside No. 1 9 Kings Road, Uxbridge be removed and replaced with a section of 'Monday to Friday 9am to 5pm' waiting restrictions as proposed and indicated on Appendix A. 3. Reasons for decision To allow clear vehicular access to a planned individual vehicle crossing being constructed outside No. 19 Kings Road, Uxbridge which is being installed by the Council’s Highways Team. 4. Proposal 1. The Council’s Highways Team received a request for a new vehicle crossing to be constructed outside No. 19 Kings Road, Uxbridge. Prior to work commencing on the construction of this new vehicle crossing, a section of the Zone U5 permit holder parking place will need to be removed from directly outside where the new vehicle crossing is planned in order to ensure unimpeded access and egress to the off -street parking facility that is being created at this property. 2. Following the above, formal consultation was carried out on these amendments to facilitate the installation of this and other new vehicle crossings within Parking Management Schemes. The consultation was carried out between 20 th May to 10th June 2026. Adjacent residents were delivered a letter and plan of the proposed amendments as well as a public notice placed on the adjacent signpost for the affected parking place. A plan of the proposals is attached as Appendix A to this report. 3. It was proposed that a section of the parking place outside No. 19 Kings Road be completely removed and replaced with a 'Monday to Friday 9am to 5pm' waiting restriction in order to prevent other drivers from causing an obstruction once the dropped kerb has been constructed. Attached as Appendix A to this report is a plan of the proposals. 4. During the consultation period, the Council received an objection from a resident who lives near to where the amendments have been proposed. The comments made in response are quoted below, with a minor redaction to protect their identity: I have noted the proposed amendments for a new vehicle crossover concerning 19 K ings Road. There is already limited parking within this section of Kings Road. We oppose the 0.9m Executive Decision Report Cabinet Member Monday, 30 June 2025 Classification: Part 1 Public Page 3 metre proposal for the new single yellow line and terminal which would limit parking space to the north of 19 Kings Road between 9am and 5pm Monday to Friday. We are in agreement that 0.5 metre yellow line and terminal would be more appropriate and is in line with the other side of the Terminal which is 0.5 metres on the other end of terminal. Half of a metre makes a lot of difference especially when one can park on the yellow line after 5PM anyway and at Weekends. We pay for parking on the road with our parking permits and our council tax. Hopefully we can resolve this matter amicably. 5. It would appear that the main concern of this resident is in relation to the loss of on- street parking as a result of the proposed changes to accommodate the new vehicle crossing. They are suggesting that the parking place to the north of No. 19 Kings Road begin closer to the new vehicle crossing so that the remaining space can still accommodate the same number of vehicles. They feel there is little point in providing such clearances to new vehicle crossovers if any of the restrictions no longer operate after 5pm on weekdays or at weekends. 6. In response to the objection, it is the Council’s usual practice to provide adequate spacing between the top of a vehicle crossing taper and start of a designated parking place. As a vehicle could potentially park with all four of its wheels within the bay markings, with either the front or rear of the vehicle overhanging the bay markings, to ensure clear access can be maintained a gap must be provided between the end of the vehicle crossing and the parking place. In this case the same spacing has been provided between the northern and southern extents of the new vehicle crossing and these are also in line with the spacing distances provided to other vehicle crossovers throughout the street. The difference in measures on the plan reflect the positioning of the new vehicle crossover and are not reflective of the gap being provided. 7. Whilst the operating times of the scheme effectively mean both the waiting restrictions and parking place are no longer in operation past 5pm on weekdays or on weekends , when designating a parking place marked on the public Highway the Council must ensure that such a marking doesn’t cause any possible obstruction and is safe space for parking . The design principles for these schemes are the same whether they operation for a single hour of the day or at any time. 8. In addition to the above, t he Cabinet Member will be aware that the public have a legal right to gain access to their property from the highway. When determining an application for a new vehicle crossing, Section 184 of the Highways Act gives guidance to Highway Authorities in so much as they are only able to ensure that, so far as is practicable, there is safe access to and egress from the premises and there is a need to facilitate so far as practicable the passage of vehicular traffic in highways. The Hig hways Authority should also take into consideration any physical obstruction preventing the installation. In this case the Council's Highways officers have assessed the points above and have identified no legal basis to reject the application and therefore propose to proceed with the installation of the new vehicle crossing. 9. Following investigation, officers have been unable to identify another location nearby that is within Kings Road where it would be possible to consider the installation of an additional permit holder parking place to offset the loss of parking as a result of these changes. The removal of the parking place outside No. 19 Kings Road will result in the loss of part of a permit holder parking space. Highways colleagues have advised that the new driveway that has been constructed will off-set the loss of on-street parking. It is therefore recommended to proceed with the changes to the parking outside No. 19 Kings Road as proposed and indicated on Appendix A. 5. As is usual practice, this notice will consist of at least five other vehicle crossover amendments which will have passed consultation and will be fully funded by the applicants of these new or extended vehicle crossings. b) Legal This report confirms that th e Council has received an application under section 184 of the Highways Act 1980 for the construction of a vehicle crossover (also known as a ‘dropped kerb’) at 19 Kings Road, Uxbridge. This report states that there is no legal basis on which to reject the application. In order to ensure unimpeded access and egress to the off -street parking facility that is being created at 19 Kings Road by prevent ing other drivers from causing an obstruction once the dropped kerb has been constructed, it is being recommended that a section of the Zone U5 permit holder parking place be removed from directly outside the property and replaced with a ‘Monday to Friday, 9am to 5pm’ waiting restriction. The powers to do this are contained in the Road Traffic Regulation Act 1984. The consultation and order-making statutory procedures to be followed are set out in Schedule 9 of the Road Traffic Regulation Act 1984 and the Local Authorities’ Traffic Orders (Procedures) (England and Wales) Regulations 1996. Consultation must also meet the standard set by established common law principles in public law, namely fairness and adequacy. In exercising any of the powers under the Road Traffic Regulation Act 1984, section 122 of the 1984 Act requires the Council to consider its statutory duty to secure the expeditious, convenient and safe movement of vehicular and other traffic ( including pedestrians), and the provision of Executive Decision Report Cabinet Member Monday, 30 June 2025 Classification: Part 1 Public Page 5 suitable and adequate parking facilities on and off the highway. These powers must be exercised so far as practicable having regard to the following matters: (a) the desirability of securing and maintaining reasonable access to premises; (b) the effect on the amenities of any locality affected and the importance of regulating and restricting the use of roads by heavy commercial vehicles, so as to preserve or improve amenities of the areas through which the roads run; (c) the national air quality strategy; (d) the importance of facilitating the passage of public service vehicles and of securing the safety and convenience of persons using or desiring to use such vehicles; and (e) any other matters appearing to the Council to be relevant. Availability of off -street parking and safe access to the driveway , identified in this report , are relevant considerations in deciding whether to make the recommended form of order. Moreover, the Council has various statutory duties in relation to road safety, such as under the Road Traffic Act 1988 and the Traffic Management Act 2004, which are relevant when deciding on road traffic measures. To this end, the report states that the proposed change will ensure safe and unobstructed access to a new off -street parking facility at the property in line with standard Highways practice and that, w ithout this amendment, parked vehicles could obstruct the crossover due to overhang beyond marked bays. Pursuant to established public law principles on consultation, the decision maker, when deciding whether to approve the recommendation to remove part of the Zone U5 permit holder parking place outside 19 Kings Road, Uxbridge must be satisfied that all consultation responses, including those that do not accord with the officer's recommendation , were conscientiously taken into account. Regulation 13 of the Local Authorities’ Traffic Orders (Procedures) (England and Wales) Regulations 1996 also requires the Council to consider all objections made. The Council must also be continually mindful of its public sector equality duty under section 149 of the Equality Act 2010. c) Alternative options Alternative Options Rationale for rejecting option Option A – Revise the proposals so more of the parking place north of 19 Kings Road remains closer to the top of new vehicle crossing taper. This has been rejected as vehicles parking with all four wheels could overhang the bay markings and still cause an obstruction to the new vehicle crossover if positioned closer. The distances that were proposed are in line with the spacing provided to other vehicle crossovers throughout the street. Option B – Retain the parking place with a white bar marking Kings Road, Uxbridge has an individual parking place layout. Do nothing No changes to the extents of the parking place outside No. 19 Kings Road could cause an obstruction to the off-street parking area being created at this address d) Risk management Risk Mitigation Failure to implement changes within two years of formal consultation to comply with The Local Authorities' Traffic Orders (Procedure) (England and Wales) Regulations 1996 S.16 (2) Direct instruction to the Highways Delivery Manager to install the scheme within the specified time frame. e) Other implications NIL. 6. Consultation & engagement Formal consultation was carried out on the amendments set out in this report, to facilitate the installation of this and other new vehicle crossings within Parking Management Schemes. The consultation was carried out between 20th May to 10th June 2026. A plan of the proposals is attached as Appendix A to this report. 8. Timetable for implementation Upon the recommendations of this report being approved subject to call -in, the final part of the legal order making process will be completed combined with other vehicle crossovers across the Borough. These notices of making are usually published around every 2 to 4 months depending on how many amendments have been proposed recently. Once the order making process is in hand the plans of the works required will be provided to the Council’s Highways Team to implement with the actual works to install the new vehicle crossing at this address. Reason for decision The Cabinet Member for Residents’ Services noted the
responses received to the formal consultation regarding the
proposed removal of part of the Zone U5 permit holder
parking place outside 19 Kings Road, Uxbridge. Following
advice from the Council’s Highways Team, the removal of
part of the parking place was approved and it was agreed
that it be replaced with a section of Monday to Friday,
9.00am to 5.00pm waiting restrictions, as set out in
Appendix A. The decision was made to allow clear vehicular

The alternative options were considered and rejected.
Revising the proposal or retaining the parking place with a
white bar marking could have resulted in obstruction of the
new vehicle crossover. The option of making no changes
was also rejected as it could have obstructed the new off -
street parking area.
