Summary
To inform the Cabinet Member of the outcome of the formal
consultation undertaken in Warwick Road and Lantern Way, West
Drayton, for the possible extension of the operational times of the
West Drayton Parking Management Scheme.

These recommendations are in line with the views expressed during the informal consultation and
are supported by the local ward councillors.

SUPPORTING INFORMATION
1. The previous Cabinet Member for Planning and Transportation heard a petition with 25
signatures from residents of Warwick Road, West Drayton. The petition stated the following:
"I enclose a petition from the residents of "Warwick Road" requesting the change in band from
WD1 to U1 (9am to 10pm 7 days a week). The request reflects the serious issues residents face
due to commuters parking their car after current enforcement hours."

A plan showing Warwick Road and the surrounding area is attached as Appendix A to this
report. Warwick Road is a residential road situated to the east of West Drayton town centre with
easy pedestrian access to West Drayton Station. Part of t he road provides through access
between Station Road and Brandville Road and the eastern end is effectively a no through road
but provides access to Lantern Way only. Currently Warwick Road and many of the other nearby
roads in the surrounding area benefit from being part of the West Drayton Parking Management
Scheme, which currently operates 'Monday to Friday 9am to 5pm'. The petition indicated that
residents are finding it increasingly difficult to find a parking space outside of the parking scheme
operational hours due to commuter parking probably associated with the proximity of West
Drayton Station and the town centre.

Although the petitioners mentioned that they would like their road to be changed over from
Zone WD1 to Zone U1 permits, as this scheme is some distance away in Uxbridge Town Centre,
this was not deemed a practical option. At the petition meeting, residents did however confirm
that what they were in effect asking for is the scheme times to be extended to match the same
times as some of the roads within Zone U1 scheme which operate "9am to 10pm 7 days a week".
Petitioners were effectively requesting that the times of the existing parking scheme be extended
to prevent non-residential parking. The Cabinet Member was aware of similar requests in recent
years from other roads in Hillingdon usually related to roads close to town centres. The Council
extended the operational times of other parking schemes to '9am to 10pm everyday' such as in
parts of Zones U1 and U3 in Uxbridge whic h have proven successful in addressing residents’
concerns. This approach was therefore considered as a viable option for the residents of Warwick
Road.

At the petition hearing the Cabinet Member discussed with petitioners their concerns and
asked officers to add this request to the future parking scheme programme to conduct an informal

consultation in Warwick Road and Lant ern Way. The Cabinet Member also asked officers to
discuss the matter further with the local ward councillors before commencing consultation to see
if they would like any of the other nearby roads to also be included within the same consultation.
5. Following discussions with the local ward councillors and the Cabinet Member, the
decision was made to conduct an informal consultation asking residents if they supported
changing the operational hours of the scheme to everyday 9am -10pm. It was agreed that t his
consultation was to be limited to Warwick Road and Lantern Way only.
6. As part of the informal consultation, a consultation pack was delivered to every property in
the area consisting of a letter, a questionnaire and a reply-paid return envelope.
7. As can be seen from the results of the informal consultation t abulated below, a slight
majority of residents that responded to the consultation indicated support for the possible
extension to the current times of operation.

8. Based on the results above, and following discussions with local ward councillors, it was
recommended that the Council conduct a formal consultation on extending the operating hours
of the Resident Parking Scheme in Warwick Road and Lantern Way to 9am -10pm every day.
This re commendation was agreed by the Cabinet Member and a formal consultation was
prepared.
9. The formal consultation, lasting for a period of 21 days was then undertaken, whereby a
letter was sent to every property in Lantern Way and Warwick Road informing them of the
Council’s intention to extend the operating hours of the scheme. During this period, street notices
were erected and public notices were placed in the London Gazette and a local newspaper.
10. During the formal consultation ten objections were received and two responses in support
of the proposals were submitted. A breakdown of the comments received, and officer responses,
is attached to this report as Appendix B. This breakdown of the responses was then shared with
local ward councillors.
11. Based on the feedback received during the formal consultation and the closeness of the
results of the informal consultation, it is therefore recommended that these proposals be deferred
at the present time.

The benefit or impact upon Hillingdon residents, service users and communities
None at this stage.
Consultation carried out or required
Residents of Warwick Road and Lantern Close were formally consulted to see if they would like
the days of operation and operating hours extended in the local Resident Parking Scheme.

Corporate Finance
Corporate Finance has reviewed the recommendations to this report and concurs with the
financial implications as set out above.
Legal
The decision makers must ensure that there is full consideration of the representations that have
been received. In exercising the power not to extend the operating days/times of the West Drayton
Parking Management Scheme in Warwick Road and Lantern Way the Council has to consider its
statutory duty under section 122 of the Road Traffic Regulation Act 1984 to secure the
expeditious, convenient and safe movement of vehicular and other traffic. The statutory duty must
be balanced with the concerns raised by any objectors.
In considering the responses received, the Council must ensure that there is a full consideration
of all representations arising including those which do not accord with the officer’s
recommendation. The Council must be satisfied that the concerns from the public have been
taken into account.
There are a set of well-established common law rules which set out the requirements of a lawful
public consultation which are known as the Gunning principles. They were endorsed by the
Supreme Court in the Moseley case.
The principles can be summarised as follows:
• Consultation should occur when proposals are at a formative stage;
• Consultations should give sufficient reasons for any proposal to permit intelligent
consideration;
• Consultations should allow adequate time for consideration and response;
• The product of consultation should conscientiously be taken into account by the
decision maker.

There are a very significant number of judicial review cases which involve successful challenges
to the lawfulness of a consultation undertaken by a public authority, so it is imperative that the
Gunning principles are closely followed.
Should there be a decision that further measures are to be considered, then the relevant statutory
provisions will have to be identified and considered at that time.

The existing times are perfectly fit for
purpose, I find it hard to believe you got a
concensus for the change from residents. I
feel the change is driven by local
authorities to raise revenue.

I think this is a disproportionate solution, I
never found it difficult to park close to my
house.
I don't see why I should have to pay for
vouchers when people come to visit at
weekends.
Some of the problems should lessen when
the station car park reopens.

It becomes very costly when family visit
me, so they normally come after 5pm, if
this goes ahead I will see my family much

You are using these streets as cash cows.

constant stream of traffic and banging of
car doors and the late night shopping
makes it even worse.

our property, are happy with the current
restrctions and would not like to see them
increased as this would cost more in visitor

cannot get a permit as this is a private
development and we have two cars, so the
increased times will be a problem for us.

commuter parking but this could have been

convenient unless additional resident
permits are supplied free.
We have never found it difficult to find a
parking space, so see no reason the
restrictions should be increased.

Reducing the amount of parking at the
weekend will make the road safer.

When the scheme was first introduced it
prevented commuter parking which was an
improvement, but on Saturdays people
would come to the town centre for
shopping and leave little space for
residents. I have also noticed people
arriving Friday evening and returning late
on Sunday, especially in the Summer.
I would recommend extending the scheme
to include Saturday, but extending the
scheme to 10pm every day is very severe.
I have family members that come in the
eveningto help with food and cleaning
needs and our resident visitor tickets have
now doubled in price.

I have regular visitors that are a lifeline,
these proposals will penalise me and make
me endure more solitude, and cost me an
unreasonable amount of money for my
visitors.
Why was there no consultation on this?
Residents should have more vouchers,
especially non-car owners, it's profiteering.
It only needs to be one hour a day to stop
commuter parking.

I don't understand why the times need to
be extended, this is taking away our
freedome to have visitors without having
to pay the Council extra money.
You should offer shorter hours such as
lunch time only and maybe a single hour
later in the day, say 7-8pm.
