That the Cabinet Member for Property, Highways & Transport
agreed the terms for the
surrender and simultaneous grant of a
new lease negotiated by officers as detailed in this report and
authorised Legal Services to complete the new lease on these
terms.
Reason for decision The Cabinet Member is being asked to agree the proposed surrender
and re- grant of the lease in accordance with the Council’s
Constitution. This requires the Cabinet Member for Property,
Highways & Transport to formally authorise the grant of a lease of
more than 7 years and/or at a rent of between £10k - £100k.
Alternative options
considered and
rejected
The Cabinet Member could choose not to approve the proposed
transaction. The result of this would mean that the existing lease,
dated 25 January 2022, would remai n in force (until expiry on 31
January 2030) and that the Lessee would neither be able to assign
their lease nor sell their business (See supporting information below).
