Financial Cost The cost associated with the recommendations to this report is estimated at £2,000 and will be fully funded from the Town Centre & Shopping Parades Initiative 2023-24. RECOMMENDATIONS That the Cabinet Member: 1) Considers the objection received from the statutory consultation for the proposed ‘Goods Vehicle Only’ loading bay in Sutton Court Road, Hillingdon; and 2) Approves the installation of the ‘Goods Vehicle Only’ loading bay in Sutton Court Road as proposed. Reasons for recommendation The recommendations reflect the responses received to the statutory consultation on a proposed ‘Goods Vehicle Only’ loading bay in Sutton Court Road. Cabinet Member Report – 21 February 2024 Page 2 Part I – Public Alternative options considered The Cabinet Member could decide not to proceed with the installation of a ‘Goods Vehicle Only’ loading bay in Sutton Court Road. Select Committee comments None at this stage. SUPPORTING INFORMATION 1. Sutton Court Road Parade is a Council-owned shopping parade within the Hillingdon East Ward. Public realm improvements as part of the Town Centre & Shopping Parades Initiative (2023/ 2024) have concluded and include: - • New paving throughout the shopping parade; • Implementation of a new central boulevard and landscaping, with eight new trees; • New street lighting with dual lanterns, retaining the ability to hold floral displays and Christmas lights. 2. The Cabinet Member will recall , shop owners had put forward a specific request for a dedicated loading bay adjacent to Burrage Bakery at No. 2 Sutton Court Road as part of a previous petition submitted relating to the improvements scheme for the area. Following investigation, officers were able to develop proposals for a dedicated loading bay operational ‘Monday to Saturday, 7am to 7pm’ adjacent to No. 2 Sutton Court Road, as shown in Appendix A. 3. The statutory consultation process started on 06 December 2023 and ran until 03 January 2024. This involved the placing of advertisements in the local press and the display of public notices on site. A formal consultation letter was also sent to the business premises along the parade. 4. During the statutory consultation, the Council received one objection from a local business with the following concerns: “Clearly this proposal has come from one or two disgruntled shop owners who are choosing to ignore the fact that there is a service road behind all of the shops that is specifically designed for all deliveries, with access to the store rooms and back entrances to the shops. This is how we receive our deliveries and this is how the other shops should receive their deliveries. The area that has been proposed as a loading bay is one of the few remaining areas left for the council's residents to park their cars with the council having removed all other parking spaces to facilitate their 'road improvement scheme'. A Goods Vehicle Loading Bay is completely unnecessary and will increase the existing parking crisis and create more problems and tension between residents and businesses. The shops should use the service road provided for deliveries.” Whilst the objector is correct in stating that the parade does benefit from a service road to the rear of the building, the geometry of the access and the positioning of the security access gates means that larger delivery vehicles , which service a number of the businesses in the parade, would not be able to manoeuvre t he vehicles to access the service road. For this reason, many of the deliveries take place from the front of the Cabinet Member Report – 21 February 2024 Page 3 Part I – Public businesses. So as not to take away from available on-street parking for shoppers, officers identified a section of Housing land adjacent to the parade, suitable for a dedicated ‘Goods Vehicle Only’ loading bay. The location of the bay was fully supported by the Housing Team. The Cabinet Member will also recall the request for a dedicated loading bay for the parade was suggested and supported by local businesses in attendance at a recent P etition Hearing relating to the improvements in the area. 5. Following consideration of the single objection received, it is recommended that the Cabinet Member approves the implementation of a dedicated ‘Goods Vehicle Only’ loading bay in Sutton Court Road as proposed. Financial Implications The costs associated with the proposed ‘Goods Vehicle Only’ loading bay as detailed in the main body of the report is estimated at £2k. This estimated cost of £2k was within the Town Centres and Shopping Parades Initiatives 2023/24 Capital Release No 1 Report with a total project cost of £460k for the Public Realm Improvement at Sutton Court Parade, which was approved for release from the Town Centres and Shopping Parades Initiatives 20224 capital budget with effect from 28 April 2023. RESIDENT BENEFIT & CONSULTATION The benefit or impact upon residents, service users and communities The proposals look to provide a dedicated ‘Goods Vehicle Only’ loading bay for local businesses and maximising on-street parking availability for local residents. Consultation carried out or required Statutory consultation has been carried out on this proposal through a notice on site and in the local press. Local Ward Councillors have also been consulted. CORPORATE CONSIDERATIONS Corporate Finance Corporate Finance has reviewed the report and concurs with the financial implications set out above noting that the proposed costs associated with the proposed ‘Goods Vehicle Only’ bay as detailed in the above report are to be funded from the 2023/24 Town Centres and Shopping Parades Initiatives capital budget. Legal The Council’s power to make orders recommended in this report is set out in Part I of the Road Traffic Regulation Act 1984. Cabinet Member Report – 21 February 2024 Page 4 Part I – Public The consultation and order making statutory procedures to be followed in this matter are set out in The Local Authorities’ Traffic Orders (Procedures) (England and Wales) Regulations 1996 (SI 1996/2489). This requires the Council to consider all objections made (Regulation 13). Pursuant to section 122 of the Road Traffic Regulation Act 1984, in considering the consultation responses, the Council must balance the concerns of the objectors with the statutory duty to secure the expeditious, convenient, and safe movement of vehicular and other traffic. In considering the consultation responses, the Council must ensure that there is a full consideration of all representations including those which do not accord with the officer's recommendation. The Council must be satisfied that responses from the publi c were conscientiously taken into account. The Council must also be mindful of its public sector equality duty under section 149 of the Equality Act 2010. Whenever necessary legal advice is given in relation to specific issues as they arise to ensure that the Council always meets its legal obligations. BACKGROUND PAPERS NIL.
