Putting our Residents First The request can be considered as part of the Council’s annual programme of road safety initiatives. Financial Cost The estimated cost associated with the recommendations in this report is £460, to be managed within existing Transportation Service revenue budgets. Considers the objections received from the statutory consultation for the proposed ‘at any time’ waiting restrictions on Cornwall Road, Uxbridge. 2. A pproves the introduction of the amended proposal for ‘At Any Time’ waiting restrictions on Cornwall Road, Uxbridge, as shown at Appendix C to this report and review the parking situation once these restrictions have been installed. Reasons for recommendations To improve access on Cornwall Road yet still maintaining parking for residents. Cabinet Member Report –17 July 2024 Page 2 Part I - Public Alternative options considered/ risk management The Council could decide to proceed with the installation of the ‘at any time’ waiting restrictions as advertised or not to proceed with any of the proposed ‘at any time’ waiting restrictions as advertised. Democratic compliance/ previous authority None at this stage. Select Committee comments None at this stage. SUPPORTING INFORMATION 1. Cornwall Road is a residential road within Uxbridge Ward. The road lies within the Uxbridge Parking Management Scheme, with operational hours Mon to Sat 9am - 5pm. A plan of the area is shown on Appendix A to this report. 2. The Council received a request from a resident of Cornwall Road for the single yellow lines on the bend to be amended to double yellow lines to improve access d ue to parked vehicles parking on the bend outside of the operational hours of the current scheme. As a consequence, a detailed site investigation was undertaken by Council officers. 3. Officers observed that vehicles were parking on the inside of the bend, which reduced the carriageway to one lane and restricted sight lines of oncoming vehicles. 4. As a result of the site observations a proposal was developed to increase the single yellow lines to double yellow lines on the inside of the bend, to keep the bend clear and maintain safety. The proposed ‘at any time’ waiting restrictions are shown on the plan attached as Appendix B of this report. 5. The Cabinet Member agreed to take the proposal through the statutory 21-day consultation process, which involved the placing of advertisements in the local press and the display of public notices on site. During this period the Council received one objection and one email of support. 6. The objector stated ”To consider the proposals from a safety perspective I believe the missing dropped curbs are relevant as they determine the movement of vehicles on to the road. I would suggest that it would be more relevant to have no waiting enforcement on both sides of the road and for it to be extended to cover the dropped pavement outside no 13. Cars parked either side of the road cause vehicles to drive round the bend on the opposite side of the road with no vision of oncoming traffic; with the potential to cause a head on collision. I would appreciate these comments/observations to be noted as an ‘objection’ to ensure they are reported to the Cabinet Member for Property, Highway, and Transport, ‘to proceed with the scheme but modified in places’”. 7. The residents who wrote in expressing support of the proposals stated “the drawing shows that the new double yellow line will go right across my drop curb which I don’t feel is appropriate which I would like rectified. In addition I would propose that the single yellow line opposite my drop curb is changed to a double yellow line as cars park here and this Cabinet Member Report –17 July 2024 Page 3 Part I - Public creates the same obstructive parking situation. I would also suggest that the double yellow may be extended around the full corner on the opposite side of my property to remove any issues of people parking on this side of the road. Furthermore, I would also propose that the double yellow line is extended further along opposite No13 to remove any potential for cars to park obstructively outside No13 and impede the use of their driveway. Other than the points above I fully support the proposal and would welcome its implementation as soon as possible.” 8. The local Ward Councillors have been consulted and one has responded supporting the proposal but asked for the residents' comments to be considered. 9. Taking into consideration the comment made regarding not wanting the yellow lines across their dropped kerb, a revised proposal has been drawn up removing them from the dropped kerb as shown on Appendix C to this report. 10. After careful consideration of the comments received from the statutory consultation and from the local Ward Councillors , it is recommended that the Cabinet Member agrees to proceed with the amended proposal for ‘at any time’ waiting restrictions in Cornwall Road as shown in Appendix C to this report and review the parking situation once these restrictions have been installed. Financial Implications The cost associated with the recommendations to this report is estimated at £460 and will be managed within existing revenue budgets for the Transportation Service. RESIDENT BENEFIT & CONSULTATION The benefit or impact upon Hillingdon residents, service users and communities The effect of introducing the amended proposed waiting restrictions on Cornwall Road will be that access and safety is maintained whilst maintaining parking for residents. Consultation carried out or required Consultation has been carried out on this proposal through a notice on site and in the local press. Local Ward Councillors have also been consulted. CORPORATE CONSIDERATIONS Corporate Finance Corporate Finance has reviewed the recommendations to this report and concurs with the financial implications as set out above. Legal The Council’s power to make orders introducing parking restrictions such as that proposed in this report for ‘at any time’ waiting restrictions is set out in Part I of the Road Traffic Regulation Act 1984. The consultation and order making statutory procedures to be followed in this matter are Cabinet Member Report –17 July 2024 Page 4 Part I - Public set out in The Local Authorities’ Traffic Orders (Procedures) (England and Wales) Regulations 1996 (SI 1996/2489). If the decision is taken to make the proposed order, Part V of the Road Traffic Regulation Act 1984 and the Traffic Signs Regulations and General Directions 2016 set out the signage requirements, which must be observed. In considering consultation responses, section 122 of the Road Traffic Regulation Act 1984 means that the Council must balance the concerns of the objectors with the statutory duty to secure the expeditious, convenient, and safe movement of vehicular and other traffic. The decision maker must be satisfied that responses from the public were conscientiously taken into account. The Council must also be mindful of its public sector equality duty under section 149 of the Equality Act 2010.
