Ward Colham and Cowley. RECOMMENDATIONS That the Cabinet Member: 1. Notes the objection received during the statutory consultation on proposals for ‘at any time’ waiting restrictions at the junctio n of Lees Road and Uxbridge Road, Uxbridge; and 2. Based on discussions with local Ward Councillors, asks that officers organise for the proposed ‘at any time’ waiting restrictions to be implemented at the earliest opportunity. Reasons for recommendations The proposed 'at any time' waiting restrictions at the junction of Uxbridge Road with Lees Road aim to prevent obstructive parking, which currently causes congestion and safety issues for Cabinet Member Report – 05 June 2025 Page 2 Part I – Public cyclists, buses, and other vehicles at the junction. These recommendations are in line with the views expressed by the local ward councillors. Alternative options considered/ risk management None at this stage. Select Committee comments None at this stage. SUPPORTING INFORMATION 1. The Cabinet Member will be aware that the Council received a request from a resident of Hillingdon asking for further restrictions to be considered at the junction of Lees Road and Uxbridge Road, Uxbridge to help prevent obstructive parking. 2. There is currently a single yellow line on Uxbridge Road in front of Hillingdon Parade which is operational ‘Monday to Saturday 8am to 6:30pm’. The resident advised that cars park on this single yellow line throughout the day which obstructs the cycle lane as well as the left turn lane into Lees Road. 3. Uxbridge Road is a major route which connects town centres such as Hayes, Uxbridge and Southall. There are residential properties, businesses and other many local amenities along Uxbridge Road, as well as forming the part route for numerous bus services. At Hillingdon Parade specifically, there are various businesses such as fast-food outlets, estate agents and convenience shops, which attract visitors to the parade. 4. Following thorough site investigations, officers observed vehicles park ing on the single yellow line close to the bus stop and even up to the traffic lights during controlled hours , which meant that vehicles were not able to utilise the left turn lane into Lees Road. This contributed to obstruction and congestion in both the carriageway and the cycle lane . Officers also visited the location in the evening where they found that cars were still parked on the single yellow line; although this was outside the operational hours of the restriction , this still caused major issues at the junction. Officers have therefore proposed double yellow lines to replace the single yellow line in front of Hillingdon Parade as seen in the plan attached to this report as Appendix A. 5. Officers also extended the proposed double yellow lines into Lees Road to ensure that parking does not simply transfer to this junction. 6. The formal consultation started on 19 February 2025 and ended on 12 March 2025. Properties directly affected by the proposals were sent a letter with a copy of the plans. The proposals were also advertised in the local newspaper as well as via public notices on site which were attached to nearby lamp columns or posts. 7. During the 21-day statutory consultation, the Council received one comment objecting to the proposals. 8. The objector advised: Cabinet Member Report – 05 June 2025 Page 3 Part I – Public “I am writing to formally appeal the proposed installation of double yellow lines ………..We have been made aware that this will restrict parking in front of our property, and we would like to express our concerns. As a business, accessible parking is essential for our customers and operations. The removal of parking in this area would significantly affect our ability to serve our clients and could lead to a loss of business. In light of this, we would like to suggest an alternative solution. Rather than removing parking entirely, perhaps the footpath could be made slightly smaller in order to install designated parking spaces. This would ensure that our business remains accessible to customers while also addressing any traffic concerns. We kindly ask for reconsideration of the current plan and would appreciate the opportunity to discuss this further. Thank you for your attention to this matter, and we look forward to your response.” 9. Reconstruction of the footway is not something which the Council could consider at this time, and drivers should not be parking on a single yellow line during the operational times, with the exceptions of loading and unloading or a blue badge being on display. Parking at this location has been the ‘norm’ for some time and it is understandable that there would be objections to possible double yellow lines. However, vehicles parked between the bus stop and traffic lights do cause problems with both congestion and road safety for cyclists, buses and other cars at the junction. 10. The objection was shared with local Ward Councillors who advised that they are supportive of the proposed ‘at any time’ waiting restrictions due to problems, such as congestions and safety concerns, being caused by the current parking situation. 11. In conclusion, following discussions with local Ward Councillors and consideration of the objection received to the formal consultation, it is recommended that the Cabinet Member instructs officers to organise for the implementation of the proposed double yellow line as seen in the plan attached as Appendix A. Financial Implications The estimated cost associated with the recommendations to this report is £1, 000 and will be managed within existing revenue budgets for the Transportation Service. Cabinet Member Report – 05 June 2025 Page 4 Part I – Public CORPORATE CONSIDERATIONS Corporate Finance Corporate Finance has reviewed the recommendations to this report and concurs with the financial implications as set out above. Legal The Council’s power to implement the proposed ‘at any time’ waiting restrictions at the junction of Lees Road and Uxbridge Road, Uxbridge is set out in section 6 of the Road Traffic Regulation Act 1984. The consultation and order -making statutory procedures to be followed are set out in Schedule 9 of the Road Traffic Regulation Act 1984 and the Local Authorities’ Traffic Orders (Procedures) (England and Wales) Regulations 1996. If the decision is taken to make the proposed order, Part V of the Road Traffic Regulation Act 1984 and the Traffic Signs Regulations and General Directions 2016 set out the signage requirements, which must be observed. In exercising any of the powers under the Road Traffic Regulation Act 1984, section 122 of the 1984 Act requires the Council to consider its statutory duty to secure the expeditious, convenient and safe movement of vehicular and other traffic (including pedestrians), and the provision of suitable and adequate parking facilities on and off the highway. These powers must be exercised so far as practicable having regard to the following matters: (a) the desirability of securing and maintaining reasonable access to premises; (b) the effect on the amenities of any locality affected and the importance of regulating and restricting the use of roads by heavy commercial vehicles, so as to preserve or improve amenities of the areas through which the roads run; (c) the national air quality strategy; (d) the importance of facilitating the passage of public service vehicles and of securing the safety and convenience of persons using or desiring to use such vehicles; and (e) any other matters appearing to the Council to be relevant. The Council’s statutory duty must be balanced with the concerns raised by any objectors. Moreover, pursuant to established public law principles on consultation, namely fairness and adequacy, t he decision maker , when deciding whether to approve the recommendation to introduce the proposed waiting restrictions, must be satisfied that all consultation responses , which are set out within this report, including those that do not accord with the officer’s recommendation, were conscientiously taken into account. The Council must also be mindful of its public sector equality duty under section 149 of the Equality Act 2010. Comments from other relevant service areas None at this stage. BACKGROUND PAPERS NIL.
