Summary
This report seeks Cabinet Member approval for the release of DfT
and TfL capital grant s, r elease of Struct ural Capital funds to
progress Phase 2 of the 2024/25 Highways Structural programme,
and retrospective approval of schemes drawdown from previously
released funds.

Financial Cost The report seeks the release approval of grants received from DfT
and TfL £ 354k and £200k respectively, and £ 1,395,168 from the
Highways Structural Works 2024/25 capital budget for carriageway
and footway resurfacing works at various locations in the Borough.

RECOMMENDATION
That the Cabinet Member for Property, Highways & Transport and the Cabinet Member for
Finance agree to the following:

1. Accept the Transport for London (TfL) Grant 2024/25 allocation of £200k for
Principal Roads;
2. Accept the grant award of £354k from the Department of Transport (DfT) for
Principal Road carriageway works, noting this will also be reported to Cabinet;
3. Approve release of capital funds of £ 1,949,168 for forthcoming resurfacing
carriageways and footways works , as determined by the Head of Highways and
the Cabinet Member for Property, Highways & Transport, funded as follows:
a. £1,395,168: Highways Structural Works Budget
b. £200,000: TfL Grant, Principal Road Budget
c. £354,000: DfT Grant Principal Road Budget (Appendices A1 & A2)
(For transparency , a retrospective list of carriageway and footways resurfaced
from the drawdown funds previously released in Phase 1 Highways Structural
Works Programme 2024/25 Capital Release No 1 is provided at Appendix B).
Reasons for recommendation
The recommendation seeks the release of grants already received from TfL and DfT as identified
in Appendices A1 & A2.
The recommendation also seeks the release of resources to facilitate the works identified by the
Head of Highways, with approval by the Cabinet Member , as detailed in Appendix A2 and, for
transparency, as agreed in the previous Highways Capital Release Report, schemes that have
been retrospectively selected detailed in Appendix B.
The works are prioritised to limit the deterioration of the fabric of the Borough’s highway s asset
that may result in serious failure of roads, footways, verges, highway drainage, street furniture
and improve the serviceability of the highway network ( for example, the visual appearance, the
rideability and structural integrity of the roads and pavements). The agreed value management
prioritisation criteria have been utilised for selecting roads and pavements for resurfacing.
The proposals listed in the attached Appendices have been agreed by the Cabinet Member for
Property, Highways and Transport and will be programmed for implementation by the Council's
term contractor. This will ensure road improvement works can take place as quickly as possible.
Alternative options considered / risk management
There are no al ternatives due to the level of deterioration as d elaying schemes put forward for
consideration by the Head of Highways may place additional pressure on the Council’s financial
resources should permanent repairs not be implemented in a timely manner.
In many instances, any delay of this programme may also have safety implications with a possible
consequent impact on the Public Liability Insurance budget.
Democratic compliance / previous authority
Reasons for urgency: Officers from the Service recommend that this matter be deemed urgent,
in order for the Council to be eligible for an early discount by issuing the works within the specified
period as outlined in the contact.

None at this stage. However, the Committee has undertaken an in-depth review more generally
into the Council’s road and pavement resurfacing programme.
SUPPORTING INFORMATION
All costs in Table s 1 and 2 have been calculated using the schedule of rates contained in the
Council's Highways term contract.
The cost of this programme is to be funded from the 2024/25 TfL grant already received for
Borough Principal Road Renewal Programme . The total programme of work is estimated to be
£200,000, as detailed in Appendix A and Table 1 below.

which includes £354k from DfT grant, as detailed in Appendix B and Table 2 below.

Transport for London Total Confirmed 2024/25 Budget £2,138k, Previously/Pending
Release £1,901k, Release Requested £200k – Appendix A1
The 2024/25 capital programme, approved by Cabinet and Council in February 2024, included a
budget of £9 ,000k for the Highways Structural Works Programme, funded from Council
resources. In June 2024, Cabinet approved the rephasing of £219k of unspent released budget
from 2023/24 in to 2024/25 towards schemes completing this financial year. Furthermore, the
Department of Transport (DfT) awarded a grant of £354k for principal roads, which was received
in June 2024, which has increased the budget giving a total rev ised Highways Structural Works
Programme budget for 2024/25 of £9,573k.
In October 2024, a recommendation is being presented to accept the DfT Highways grant.
The 2024/25, the Transport for London capital programme original budget, approved by Council
in February 2024, amounted to £1,458k based on the provisional LIP figure of previous year. As
at Month 2 2024/25, the Transport for London capital programme revised budget is £2,138k based
on actual grant funding confirmed by TfL.
The report seeks the capital release of £ 1,949,168 from the Highways Structural Works
Programme Budget, as detailed in Appendices A1 & A2, comprising £200k TfL grant, £354k DfT
grant and £1,395k Highways Structural Works budget.
The release of £1,949,168 includes the term contractor’s quoted costs, internal fees based on 8%
and project contingency at 10% on carriageways and footways of the contractor works cost for
both types of works after contractor discounts. These contractual discounts consist of the Timely
Release Discount (or Forward Planning Discount) of 3.75% for works being made available to the
contractor prior to August . This enables the supplier to build a greater amount of certainty into
their internal programming. There is also the Volume Discount of 4.25% for consolidating work
requirements rather than issuing multiple small task orders, applying when a task order of greater
than £500k is placed (see Appendices for details).
Recommendation 4 of t his report also includes a retrospective list in Appendix B to provide
transparency for schemes that are being implemented from the £5,000k funds released in the
previous Highways Structural Programme 2024/25 Phase 1 Report.

The carriageway resurfacing and footway improvement programme contains schemes to limit the
deterioration of the fabric of the Borough’s highway s asset that can result in serious failure of
roads, footways, verges, highway drainage and street furniture and improve the serviceability of
the highway network for the benefit of residents and other road users.

CORPORATE CONSIDERATIONS
Corporate Finance
Corporate Finance has reviewed this report and concurs with the budgetary position set out
above, noting that the £1,395,186 proposed highway structural works will be funded from the
approved Capital Budget for Highways Structural Works 2024 /25, £354,000 from the DfT grant
and £200k from the TfL Grant.
Works recommended for release total £1,949,168, including externally contracted works costs
(after contractor discounts), internal project management fees and project contingency.
Legal
Legal Services confirm that the Council, as a highway authority, is responsible for carrying out
this function pursuant to section 41 of the Highways Act 1980.
Thus, there are no legal impediments to the Council following the recommendations set out in this
report, although any contract that is entered into by the Council must comply with the Council's
current Procurement Standing Orders, which were last updated effective 11 July 2024.

Infrastructure / Asset Management officers have authored the report.
Capital Release Protocol
The release of all capital funds, and certain revenue funds, held by the Council is to be made by
a formal democratic decision (by the Cabinet Member for Finance and other relevant Cabinet
Members). No expenditure can be placed or committed by officers until this formal approval is
given by Democratic Services. Release of funds must be for identified projects only and strictly
not for general release of funds for projects to be identified at a later date. No block releases of
capital will be allowed, except if authorised by the Leader of the Council in advance to Corporate
Finance. The release of funds will only be made if previous Council, Cabinet or Cabinet Member
agreement has been given to the project and only if there is an approved budget.

decision be
implemented by
officers?
This decision was deemed urgent and the agreement that
the matter was urgent and could not have been reasonably
deferred was also granted by the Chair of the Corporate
Resources & Infrastructure Select Committee.
Reasons for urgency was to enable a discount for the works
within the specified period as outlined in the contract.
However, the scrutiny call-in period will continue to apply to
this decision so the decision comes into effect on Friday 27
September 2024 at 5pm.
