Financial Cost The estimated cost associated with the recommendations in this report is £480, to be managed within existing Transportation Service revenue budgets. Considers the objection received from the statutory consultation for the proposed ‘at any time’ waiting restrictions on Waltham Avenue, Hayes. 2. Approves the introduction of the proposed ‘At Any Time’ waiting restrictions on Waltham Avenue, Hayes, as shown at Appendix B to this report. Cabinet / Cabinet Member Report – 13 December 2024 Page 2 (Part 1 Public) Reasons for recommendation(s) To improve sight lines on Waltham Avenue whilst maintaining parking for residents. Alternative options considered / risk management The Council could decide not to proceed with the installation of the ‘at any time’ waiting restrictions as advertised. Democratic compliance / previous authority None at this stage. Select Committee comments None at this stage. SUPPORTING INFORMATION 1. Waltham Avenue is a residential road within Pinkwell Ward. The road is split in t wo by Mildred Avenue. The relevant section of Waltham Avenue is a dead end, leading to a public car park for a recreation park. A plan of the area is shown on Appendix A to this report. 2. The Council received a request from a resident of Waltham Avenue asking for waiting restrictions on the bend to improve road safety and sightlines which are reduced due to parked vehicles parking on the bend. As a consequence, a detailed site investigation was undertaken by Council officers. 3. Officers observed that vehicles were parking on the bend. These vehicles restricted sight lines for vehicles on the bend, especially as some of these vehicles were large vans. 4. As a result of the site observations, a proposal was developed to install double yellow lines on the bend in order to keep this area clear of parked cars, in order to improve forward visibility and promote road safety. The proposed ‘at any time’ waiting restrictions are shown on the plan attached as Appendix B of this report. 5. The Cabinet Member of the time agreed to take the proposal through the statutory 21- day consultation process, which involved the placing of advertisements in the local press and the display of public notices on site. During this period, the Council received one objection and one letter of support. 6. The objector stated “I think it is not a good idea. It is very difficult to park a vehicle in the evening. Recently, there have been a lot of cars on the street, mainly delivery vehicles, and every space counts. Additionally. Many additional cars often come into the community in front of the planned restrictions. Taking away parking spaces will make life difficult for local residents.” Cabinet / Cabinet Member Report – 13 December 2024 Page 3 (Part 1 Public) 7. The supporter stated “I agree it would be of beneficial advantage as the parking has become intolerable making it difficult for us to safely park on our drive. There have been occasions when the dust carts have not been able to get through to the end of the road owing to large vans parking on both sides of the road. I also believe that a double yellow line opposite in front of the alley way would stop people parking across the alley making it difficult for anyone with mobility issues.” 8. The local Ward Councillors have been consulted and all three have responded supporting the proposal. 9. After careful consideration of the comments received from the statutory consultation and from the local Ward Councillors, it is recommended that the Cabinet Member agrees to proceed with the proposed ‘at any time’ waiting restrictions o n Waltham Avenue, Hayes in Appendix B to this report. Financial Implications The cost associated with the recommendations to this report is estimated at £480 and will be managed within existing revenue budgets for the Transportation Service. RESIDENT BENEFIT & CONSULTATION The benefit or impact upon Hillingdon residents, service users and communities The effect of introducing the proposed waiting restrictions on Waltham Avenue will be that access and safety is maintained whilst maintaining parking for residents. Consultation & Engagement carried out (or required) Consultation has been carried out on this proposal through a notice on site and in the local press. Local Ward Councillors have also been consulted. CORPORATE CONSIDERATIONS Corporate Finance Corporate Finance has reviewed the recommendations to this report and concurs with the financial implications as set out above. Legal The Council’s power to implement proposed 'at any time' waiting restrictions on Waltham Avenue, Hayes is set out in Part I of the Road Traffic Regulation Act 1984. The consultation and order making statutory procedures to be followed in this matter are set out in The Local Authorities’ Traffic Orders (Procedures) (England and Wales) Regulations 1996 (SI 1996/2489). Cabinet / Cabinet Member Report – 13 December 2024 Page 4 (Part 1 Public) If the decision is taken to make the proposed order, Part V of the Road Traffic Regulation Act 1984 and the Traffic Signs Regulations and General Directions 2016 set out the signage requirements, which must be observed. In considering consultation responses, section 122 of the Road Traffic Regulation Act 1984 requires the Council to balance the concerns of the objectors with the statutory duty to secure the expeditious, convenient and safe movement of vehicular and other traffic. The decision maker must be satisfied that responses from the public were conscientiously taken into account. The Council must also be mindful of its public sector equality duty under section 149 of the Equality Act 2010.
