Approved
That the Leader of the Council and the Cabinet Member for
Property, Highways and Transport agree d with the rent
negotiated by officers as detailed in th e report and
instructed Property and Estates to complete the
appropriate rent review memorandum.
Reason for decision To consider a rent review on a commercial property where the
Council wa s landlord. The Leader and Cabinet Member we re
asked to agree the proposed rent in accordance with the
Council's Constitution. This required the Leader and Cabinet
Member to formally agree to any rent review.
Alternative options
considered and
rejected
The Leader and Cabinet Member could have chosen not to
approve the rent review negotiated. This would be likely to then
require the rent review to be referred for third party
determination by arbitration. This would have involved a degree
of risk as third- party determination could have resulted in a
rental figure being determined above or below the rent
negotiated between parties and result in substantial arbitration
fees on both sides.
