Title of decision COMMERCIAL PROPERTY RENT REVIEW – SUTTON

Decision made
Cabinet Members making
the decision
Councillor Jonathan Bianco – Cabinet Member for
Corporate Services & Property
Decision APPROVED
The Cabinet Member agreed with the rent negotiated by
officers as detailed in th e confidential report and
instructed Property and Estates to complete
the appropriate rent review memorandum.
Reason for decision The recommendations ensured that the agreed -in-principle
rent increase negotiated with the tenant was approved,
securing an uplift in rental income for the General Fund and
reflecting prevailing market conditions.
This approach provided a positive outcome for the parade
while avoiding the risks, uncertainty and potential costs
associated with referral to third-party determination through
arbitration.
Alternative options
considered and rejected
The alternative is not to approve the agreed -in-
principle rental increase for this rent review. This is likely to
lead to the rent review being referred for third party
determination by arbitration. This action will involve a degree
of risk as third -party
determination may result in a rental
figure being determined above or below the rent negotiated
between parties and result in substantial arbitration fees on
both sides.
