Putting our Residents First The request can be considered as part of the Council’s annual programme of road safety initiatives. Financial Cost There are no costs associated with the recommendations to this report. Considers the objections received from the statutory consultation for the proposed ‘At Any Time’ waiting restrictions on the junction of Bushey Road and Bushey Close, Ickenham; 2. Does not approve the introduction of the proposed ‘At Any Time’ waiting restrictions on the junction of Bushey Road and Bushey Close, Ickenham, as shown on Appendix B, but keep the area under review; Cabinet Member Report – 13 February 2024 Page 2 Part 1 Public Reasons for recommendation Taking into consideration the comments received during the consultation and from the local Ward Councillors. Alternative options considered / risk management The Council could decide to proceed with the installation of the ’At Any Time’ waiting restrictions as advertised. Democratic compliance / previous authority None at this stage. Select Committee comments None at this stage. SUPPORTING INFORMATION 1. Bushey Road and Bushey Close are mainly residential roads within Ickenham & South Harefield Ward. Breakspear Junior School is on Bushey Road opposite Bushey Close. Bushey Close is a small cul -de-sac of 10 properties. Bushey Road leads into Copthall Road East then into Swakeleys Road, a main route to Uxbridge and Ickenham. A plan of the area is shown on Appendix A to this report. 2. The Council received a request from a local resident asking for measure to deter vehicles from parking on the junction of Bushey Road and Bushey Close restricting sight lines when exiting Bushey C lose. As a consequence, a detailed site investigation was undertaken by council officers. 3. Officers observed that vehicles were parking on the junction on Bushey Road. These vehicles could restrict sight lines for vehicles exiting Bushey Close. 4. As a result of the site observations , a proposal was developed to install double yellow lines on the junction. This will still maintain parking in the rest of the road but improve sight lines and pedestrian safety . The proposed waiting restrictions are shown on the plan attached as Appendix B to this report. 5. The Cabinet Member agreed to take the proposal through the statutory 21 -day consultation process, which involved the placing of advertisements in the local press and the display of public notices on site. During this period the Council received two objections to the proposal. 6. The first objector stated “ Due to inconsiderate parking and selfish attitude by certain people whilst dropping their children at Breakspear School it has come to my attention that one of my neighbours reported this as a problem to London Borough of Hillingdon Cabinet Member Report – 13 February 2024 Page 3 Part 1 Public without consultation with the rest of the neighbours in Bushey Close. The result seems to be the notice you have put up at the end of this close. That being the case my opinion is that parking restrictions should be limited if absolutely necessary, to the proposed double yellow lines but not to the extent that you are putting forward. I certainly would object to anything else and in particular resident parking. 6 meters into a short close is very restrictive to not only the residents, but their visitors and parents at Breakspear School that are considerate when they park. The more restriction you impose on the resident parking, the more this affects the parents delivering their children to school. It just extends the parking issues further away, causing stress and inconvenience to everyone. Living close to a school, I naturally expect to experience extra traffic at school peak times. Double yellow lines would be acceptable if they were shorter. Maximum 3 meters which would allow for drivers coming out of the close to see into Bushey Road and allow pedestrians to cross Bushey Close without having to step around parked vehicles into Bushey Road which is potentially dangerous. I cannot make a comment for the residents in Bushey Road, although again the proposed 7&8 metres seem excessive and restrictive.” 7. The second objector stated “ This request was made by a resident of Bushey Close for the lines to be put in place in order to prevent parking at the entrance to Bushey Close from Bushey Road. I would like to point out that this request was made without any prior consultation with other residents living in Bushey Close. I have lived in Bushey Close for 36 years and am very much accustomed to the daily parking of parents using Bushey Close/Bushey Road to drop and collect their children at Breakspear School during peak times of the day. This has been an ongoing issue, but it is what is to be expected when living so close to a school. Our residents have, for many years, had to put up with inconsiderate parking and unacceptable behaviour from parents - especially when they have been challenged. Our concerns and complaints made to Breakspear School have always been accommodated and passed on to parents in the hope that parents would become more aware of children's safety, and to be respectful of local residents. Whilst the introduction of restricted parking at the entrance to Bushey Close, would not only be a sensible option for the safety of children and their parents crossing the road, but for drivers leaving and entering Bushey Close/Bushey Road - I feel that the proposed length of six metres for the double lines into Bushey Close is excessive for the following reasons: The length of the lines is disproportionate to the length of our Close. We already have limited road parking for visitors to our Close. The proposed six metres would force people (i.e. visiting family members, workmen, visitors to the school) to find parking further away. A maximum of three metres would be acceptable. Resident parking is NOT an option - this is something that we, as neighbours, agreed upon when we had our road resurfaced ten years' ago. We would like to object to the proposed 6 metres for the following reasons: As you have noted, Bushey Close is very small. That clear area up to the junction allows us residents just enough space, outside school hours, to frequently accommodate visitors, Cabinet Member Report – 13 February 2024 Page 4 Part 1 Public tradesmen, and our own parking needs. This sort of thing leads to more pressure on residents having to completely concrete over their front gardens. Resulting in the negative environmental impact of less greenery. It has always been like this, and it is just about manageable. A blanket parking ban of the proposed length in our close would severely impact our ability to accommodate the cars we already have here. One car length on the corners would be helpful, but no more than that. In our opinion, a maximum of 3 metres would allow enough room for visibility and safety. “ 8. The local Ward Councillors have been consulted and one has responded stating they no longer support the proposed waiting restrictions. 9. After careful consideration of comments received from the statutory consultation and the views of the local Ward Councillors , it is recommended that the Cabinet Member agrees not to proceed with the propos ed ‘At Any Time’ waiting restrictions on the junction of Bushey Road and Bushey Close in Appendix B to this report but keep the area under review. Financial Implications There are no costs associated with the recommendations to this report. RESIDENT BENEFIT & CONSULTATION The benefit or impact upon Hillingdon residents, service users and communities? There will be no changes to the parking arrangements in the road. Consultation carried out or required Consultation has been carried out on this proposal through a notice on site and in the local press. Local Ward Councillors have also been consulted. CORPORATE CONSIDERATIONS Corporate Finance Corporate Finance has reviewed the recommendations to this report and concurs with the financial implications as set out above. Legal The Council’s power to make orders introducing parking restrictions such as that proposed in this report for ‘at any time’ waiting restrictions on Bushey Road and Bushey Close is set out in Part I of the Road Traffic Regulation Act 1984. Cabinet Member Report – 13 February 2024 Page 5 Part 1 Public The consultation and order making statutory procedures to be followed in this matter are set out in The Local Authorities’ Traffic Orders (Procedures) (England and Wales) Regulations 1996 (SI 1996/2489). This requires the Council to consider all objections made (Regulation 13). Pursuant to section 122 of the Road Traffic Regulation Act 1984, in considering the consultation responses, the Council must balance the concerns of the objectors with the statutory duty to secure the expeditious, convenient, and safe movement of vehicular and other traffic. The Council must also be mindful of its public sector equality duty under section 149 of the Equality Act 2010. The Council may choose not to proceed with making the order or make an order with modifications (Regulation 14) and/or consider making an order in part (Regulation 19). If modifications are made that substantially change the order, the Council must take appropriate steps to inform anyone likely to be affected by the modifications, giving those people an opportunity to make representations. The Council must then consider any representations received. Whenever necessary legal advice is given in relation to specific issues as they arise to ensure that the Council always meets its legal obligations.
