Putting our Residents First Delivering on the Council Strategy 2022-2026 This report supports our ambition for residents / the Council of: Stay living independently for as long as they are able This report supports our commitments to residents of: Safe and Strong Communities The request can be considered as part of the Council’s annual programme of road safety initiatives. Financial Cost The estimated cost associated with the recommendations to this report is £400 and will be managed within existing revenue budgets for the Transportation Service. Notes the application for a disabled parking bay in Laurel Lane, West Drayton; 2. Considers the objection to the proposed disabled persons’ parking bay on Laurel Lane, West Drayton; and 3. Approves the installation of the proposed disabled persons’ parking bay on Laurel Lane, West Drayton, as shown in Appendix B to this report. Cabinet Member Report – 25 November 2025 Page 2 (Part 1 Public) Reasons for recommendation(s) T he formal disabled parking bay is intended to benefit disabled people by designating a parking space for the use of Blue Badge holders. A lternative options considered / risk management T he Council could decide not to proceed with the installation of the proposed disabled persons’ parking day on Laurel Lane, West Drayton. S elect Committee comments N one at this stage. SUPPORTING INFORMATION 1. Laur el Lane is a residential road within West Drayton Ward. Located on the road is Laurel Lane Primary School and a small parade of shops. St Martin’s Primary School is near to the junction of Laurel Lane and Rowan Road. It is also part of the U 3 bus route. A plan of the area is shown on Appendix A to this report. 2. T he Council received an application for a disabled parking bay from a resident of Laurel Lane. The applicant fully meets the Council's assessment criteria for the provision of an on- street disabled parking bay. A proposal was developed for an on-street disabled parking bay on Laurel Lane, the closest location to the resident’s propert y whilst maintaining as much parking for other residents. 3. A pproval was subsequently granted by Delegated Officer’s Action to progress this proposal to the statutory consultation stage. Formal notice was given of the Council’s intentions for statutory consultation on the proposal shown in Appendix B to this report, and a 21- day notice of intent was duly published. During this period, the Council received one objection to this proposed disabled parking bay. 4. T he objector stated “As a person with a mobility disability myself, I'm led to believe that any person holding a blue badge would be able to utilise the proposed space. This would also include long-term airport parkers who regularly leave vehicles for weeks on end, outside our homes, visitors, other residents, parents doing school drop offs etc. Residents of numbers 16-34 struggle to park as it is; by taking away a space, it will only make the issue worse. Surely, a better solution would be 1 marked bay for each of the 10 houses impacted by airport parking. Utilising the already present layby nearest the houses. Thereby ensuring the disabled resident ( and all other residents) can park outside their own homes and preventing the area from being used for long- term parking companies, airport workers and holiday makers (The latter who park for weeks& travel into LHR via .the U3 bus) The drivers in those 10 residences would happily pay to park, we have a residents group in constant communication with councillors to bring the matter to an acceptable conclusion.” 5. I f residents want permit parking, then the best way forward is through a petition to the Council. Cabinet Member Report – 25 November 2025 Page 3 (Part 1 Public) 6. The proposed formal disabled parking bay in Laurel Lane would be available for any Blue Badge holder to use without time limit. The Council continually reviews the use of on-street disabled parking bays and will consider their removal if they are no longer required due to either a change in circumstances, are reported to be unused, or the resident has moved away. The Council aims to install disabled bays as close to the resident's property as possible. 7. T he views of Ward Councillors were sought, and one has responded supporting the proposed disabled bay but does understand that residents are concerned with the parking situation on Laurel Lane. 8. W hilst it is understood that the provision of Blue Badge disabled bays can lead to strong feelings both for and against their introduction, the bay is proposed where residents already park and would not restrict access to any dropped kerb or the free flow of traffic. It is therefore recommended that the Council proceeds with the installation of the disabled parking bay on Laurel Lane, as shown in Appendix B to this report. F inancial Implications T he cost associated with the recommendations to this report is estimated at £4 00 and will be managed within existing revenue budgets for the Transportation Service. RESIDENT BENEFIT & CONSULTATION T he benefit or impact upon Hillingdon residents, service users and communities T he proposed disabled parking bay is intended to benefit disabled people by designating a parking space for the sole use of Blue Badge holders. C onsultation & engagement carried out (or required) C onsultation has been carried out on this proposal through a notice on site and in the local press. Local Ward Councillors have also been consulted. CORPORATE CONSIDERATIONS C orporate Finance C orporate Finance has reviewed the recommendations to this report and concurs with the financial implications as set out above. Le gal T he Council’s power to designate the proposed disabled parking bay on Laurel Lane, West Drayton is set out in section 45 of the Road Traffic Regulation Act 1984. The consultation and order-making statutory procedures to be followed are set out in Schedule 9 of the Road Traffic Regulation Act 1984 and the Local Authorities’ Traffic Orders (Procedures) (England and Wales) Cabinet Member Report – 25 November 2025 Page 4 (Part 1 Public) Regulations 1996. Consultation must also meet the standard set by established common law principles in public law, namely fairness and adequacy. I f the decision is taken to make the proposed order for the disabled parking bay on Laurel Lane, West Drayton, Part 5 of the Road Traffic Regulation Act 1984 and the Traffic Signs Regulations and General Directions 2016 set out the signage and marking requirements, which must be observed. I n exercising any of the powers under the Road Traffic Regulation Act 1984, section 122 of the 1984 Act requires the Council to consider its statutory duty to secure the expeditious, convenient and safe movement of vehicular and other traffic ( including pedestrians), and the provision of suitable and adequate parking facilities on and off the highway. These powers must be exercised so far as practicable having regard to the following matters: (a ) the desirability of securing and maintaining reasonable access to premises; (b) the effect on the amenities of any locality affected and the importance of regulating and restricting the use of roads by heavy commercial vehicles, so as to preserve or improve amenities of the areas through which the roads run; (c) the national air quality strategy; (d) the importance of facilitating the passage of public service vehicles and of securing the safety and convenience of persons using or desiring to use such vehicles; and (e) any other matters appearing to the Council to be relevant. A vailability for any Blue Badge holder to use the disabled parking bay o n Laurel Lane, West Drayton is a relevant consideration in deciding whether to make the recommended order. M oreover, the Council has various statutory duties in relation to road safety, such as under section 39 of the Road Traffic Act 1988 and section 16 of the Traffic Management Act 2004, which are relevant when deciding on road traffic measures. Pur suant to established public law principles on consultation, the decision maker, when deciding whether to approve the recommendation to introduce the proposed disabled parking bay on Laurel Lane, West Drayton must be satisfied that all consultation responses (all of which are pasted within this report), including those that do not accord with the officer's recommendation, were conscientiously taken into account. Regulation 13 of the Local Authorities’ Traffic Orders (Procedures) (England and Wales) Regulations 1996 also requires the Council to consider all objections made. The Council must also be mindful of its public sector equality duty under section 149 of the Equality Act 2010. P roperty T here are no property implications resulting from the recommendations set out in this report. C omments from other relevant service areas N one at this stage.
